Hi there, go and open a new account BEFORE you close the one you currently have. List the following information, we may be able to help you resolve the payday loan cycle without a consolidation loan:
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.

My Next Day Cash borrowed $400 I have paid them $1470 (I contacted them and they pretty much told me too bad)
PDL Ventures borrowed $350 paid them $420
Titan Group borrowed $200 paid them $900
Nationwide Cash borrowed $500 paid them $1310
VIP borrowed $500 paid them $600
PDL Ventures borrowed $350 paid them $950 (I guess I have 2 with them somehow)
These I haven't paid what the amount of the loan was back yet.
Eastside Lenders borrowed $300 have paid $245
Instant Cash borrowed $200 have paid $180
I am also afraid what will happen if I do close my bank account

So when my direct deposit hits on Friday it will clear the negative balance, but then once 8:00 hits the loans will come out again. I am never going to get this cleared up am I until I pay all these loans off?

You need to demand your bank to put your account on a freeze that allows deposits only. Go and see them in person. Explain to them that these are illegal loans and that it can turn into a legal matter. Can you go to another bank and open a account. then transfer your direct deposit to them. You really need to take control of your pay check before you will ever get through this. You are not going to be arrested for internet PDL's. As an example the Titan Group loan was for $200. If I am reading the information correctly they can really only charge me $30 on the loan as the fee and not the $60 they are charging me. The interest loan on my paperwork is 782.14% but this says 459%. It also says I can only have one out at a time I have more than that. Also what does this statment mean... "Permissible number of Rollovers - None (cannot be repaid, consolidated or refinanced)"?

If they are not licensed in your HOME state, I would reply back to them stating the fact that you do not live in the state of Delaware and that their company is NOT licensed in your HOME state and you will pay them the full 300.00 that you borrowed and nothing more.
If they continue on saying you owe them then tell them that you are going to file a complaint with your AG if they continue.

e-signature is based in the isle and providence of Nevis West Indies Bahamas.

That statement that you posted above applies to them debiting your account any further. Not all companies will grant that request and still attempt to debit your account. That is why you send them this to have your bases covered showing you sent them notification.
FYI: Try to send them the letter 7 days in advance before your next payday, if you cannot then send the letters to each PDL company ASAP!

if you gave that to the pdl's, then give your credit union a copy.your credit union should be held to the same standards as any bank.give them a copy of the ne pdl laws and state you have overpaid each of your loans,and want either the debits stopped or reversed.then do as you stated and inform your state dept of financial inst and bank division.what they are doing is disobeying a federal law in the EFT act.

After speaking to I believe Becca on the phone the other day I made some other phone calls and was made aware of this law. Federal law, Regulation E Section 205.10 Preauthorized transfers. If you look at this item...
(c) Consumer's right to stop payment--(1) Notice. A consumer may stop payment of a preauthorized electronic fund transfer from the consumer's account by notifying the financial institution orally or in writing at least three business days before the scheduled date of the transfer.
(2) Written confirmation. The financial institution may require the consumer to give written confirmation of a stop-payment order within 14 days of an oral notification. An institution that requires written confirmation shall inform the consumer of the requirement and provide the address where confirmation must be sent when the consumer gives the oral notification. An oral stop-payment order ceases to be binding after 14 days if the consumer fails to provide the required written confirmation.
I requested to stop all ACH withdrawls during my phone call on Tuesay. This would keep my account from going negative so I can close it and reopen a new one. I contacted all of the PDL companies and told them I revoke all authorization from my bank account. I also let them know the guidelines for the state of Nebraska which requires them to be licensed in Nebraska to do business here. Most of these companies owe me a refund due to these guidelines. Please let me know what else you need from me.

I will also file complaints with the Nebraska Department of Banking & Finance... those look like they are a little more paperwork. What I don't understand is my bank (credit union), the lady I talked to kept saying well they deposited money in your account so it was a loan and you owe them. I was trying to explain that I have paid that back sometimes over $1000 more than what the loan was. She helped me but she wasn't very understanding. Geez lady I messed up.

was this the manager?if so i would look into another bank once your account is in the black.if not then see the manager and let them know about this.the EFT act is a federal law,and whoever said that shouldn't work at any financial institution.

Ok so I have my bank account closed. Tricky little VIP & Next Day cash sent the payments through as checks not ACH payments, luckly my bank sent those back for me too. Now will come all the phone calls and emails telling me I owe them money and they are going to send me to jail. Most of these companies didn't respond to my original email. I am going to send them another one today. I am sure since they didn't get my money they will want to talk to me now.

some will wait,but file AG complaints for all the others.they should be able to help you with that also FTC complaints.just know these places are illegal and can't do anything except threaten.ignore eastside.i had them and they are as ignorant as they are illegal.

As long as you are dealing with companies that aren't legal lenders in your state, they can't take you to court, either (well, they could, but not successfully... so they're not gonna). If you are dealing with legal lenders, they could conceivably sue you with a hope of success, but if you are making regular payments (whether or not it's in accordance with THEIR payment plan), a judge is unlikely to rule against you.
Garnishment? If you sent that ACH auth revocation letter complete with the revocation of any wage garnishment assignments you may or may not have signed with them, then no, they can't.
The only way your wages can be garnished is (a) with a voluntary wage garnishment, which you can revoke at will, or (b) a court-ordered garnishment, for which they would have to go to court and win an action against you.
