Calling All NY Victims of United Cash Loans, US Fastcash and Ameriloan
Date: Mon, 03/22/2010 - 17:45
I took the advice of this forum and filed complaints with the NY Attorney General's Office of Consumer Frauds and Protection Bureau. I received an early November 2009 enthusiatic letter from the NY AG's office suggesting that they would be able to help mediate a settlement of my refund request of renewal fees that were significantly larger than the principal of my loans. Early last month I received another letter from Mr. Giovanni Cox who stated that " We have presented your complaint to the company. Despite our repeated efforts, they have failed to respond. Unfortunately, we cannot assist you further. We can take formal law enforcement action only when we have evidence of a business' pattern of repeated or persistent fraud, or illegality. In the case of individual complaints, our role is limited to that of mediator. Mediation is a voluntary procedure, and we cannot force either side in a dispute to settle a complaint.
As we all know on this forum, the terms of the Ameriloan, US Fastcash and United Cash Loans contracts all violate NY usury laws and small loan rate caps. In order to prompt the Attorney General's office to take formal enforcement action I am calling on all of the NY members of this site who have been victims of the above companies to send correspondence directly to Mr. Giovanni Cox of the NY Attorney General's Office of Consumer Frauds and Protection Bureau in Albany specifically stating the fact that we are trying to establish a clear pattern of repeated and persistent illegality and hopefully with enough correspondence he will feel inclined to move forward with legal action.
I have done research that showed where the Attorney General of West Virginia, a state with similiar usury laws to New York, was successful in suing and eventually settling with the firm for refunds of loan overpayments and forgiveness of outstanding collection agency debts.
Thanks to all in advance for your help with this request and hopefully we can persuade Mr. Cox to move forward with enforcement action against Miami Nation Enterprises as the West Virginia AG sucessfully did.
That's certainly a giant step towards eliminating lenders who do
That's certainly a giant step towards eliminating lenders who do not abide by the laws. Hope all NY enthusiasts would soon join hands with you in this great cause.
I have been a member of this site for a little under a year now and I can only say thanks for all of the terrific advice that I have received over the past year. With that being said I would like to call upon the NY members of this site to take a collective action against the parent corporation of the above mentioned firms; Miami Nation Enterprises of Oklahoma.

i smell a rat here, and not you dbbiz,i checked the NY AG'S website.did a search, and couldn't find the name GIOVANNI COX anywhere as part of the AG'S office.in other words i suspect this mr giovanni cox is part of MTE,and sent that letter to discourage people.a couple of points.
1)the AG'S office has been getting complaints on MTE d/b/a's for years.
2)you got a letter stating they would enthusiastically fight for you, then all of a sudden they are not.
3)having been in contact with the AG'S office before i can tell you this about face is what made me suspect something is up.
4)it is MTE to not only lie to gov't agencies, but to send false letters to people claimning to be said agency.
i just don't buy that letter.the number for the consumer frauds bureau is
1-800-771-7755.i would call that number to report this place.again i think the letter is from MTE and should be reported to another division of the AG'S office.
