Trouble with closing my account
Date: Fri, 03/26/2010 - 05:46
Today, I call again to see how to close it over the phone (I was told I could do this). Now, the woman on the phone is telling me that it's closed as long as nothing comes in as far as a deposit or debit for 30 days!!! She said they could stop payment on ACH transactions, but I told her that they may try to debit as a different company or in a different amount. To which she said, "well, yes, that will cause the account to overdraft and you will incur fees."
She transferred me to another man and he indicated the same 30 day policy. Asked me if I was having trouble with a particular company. I told him yes, but that I was at work and didn't want to discuss it over the phone. He recommended that I go in to speak with the branch manager.
When I go to the bank on Saturday...what do I ask them to do? Should I do anything else proactively to make sure these bottomfeeders don't get access to my account again? The stress level was going down, but now it's on the rise again!
Can someone offer some sound advice??
Thanks!!

have the manager put the account on DEPOSITS ONLY.that way nothing can be debited, but you still have access.you just have to go in person to withdraw money.yes the manager should be able to do that for you.btw what bank is this if you don't mind me asking.

As paulmergel says, talk to the bank manager; I can't believe they wouldn't be able to close out your account; after all, what if your checkbook were lost or stolen, would they let your account stay open in THAT instance and risk someone stealing your money? (Stop payments wouldn't really be a good idea anyhow, as so many of the PDL's operate under SO many different names; it's more than likely if they couldn't get the $$ under one name, they'd use another to access your account).

PNC did that to me.. created literally a thousand dollars of fees and me being reported to chex system :(
i agree with the above advice, put it on deposit only, than have a manager (or corporate if you have to) close it out permanately.

Actually, this is PNC Bank as well. They already do a lot of shady business with their NSF fees occuring on debits in the order they choose instead of when they were debited! Anywho...
So, I should ask for them to put the account on Deposits only (even though the call center said they couldn't do that!) and then ask them to close the account permenantly? Is this done at the same time, just in that specific order?
Thanks everyone!

hmm.. the call center, too? did you speak with the fraud department and stress these loans are not even legal! i would also report this bank, any ACH can be revoked at anytime and it should not be this hard.
but yea, deposit only is a good tempoarary fix that does work. i would wait a week than try to get them to close it out permanately.

I went in on Saturday, but had a pending payment coming in. I accidentally used the wrong debit card on Friday. So, Tuesday I can go back in to close the account. The manager wasn't there on Saturday, so I spoke with another woman. She assured me that if the account was closed properly that no ACH transaction will reopen the account. It may be received, and I may see the activity online, but that it would be reversed immediately. So, I have to find out more on Tuesday. I don't want to incur any fees. They could do something different if I was disputing any of the previous charges, but since I hadn't terminated their authorization as of then, I couldn't go that route.
I'm really hoping that everything works out since they are scheduled to debit my account on Wednesday!

I'm hoping everything works out ok for you, too. If not, I'd be back down at the branch office w/ the name of the woman who told you everything would be ok. Keep us posted.

Quick update...I wasn't able to close the account yet.
Saturday I closed out the debit/visa card associated with the account and zeroed out the account. Sunday, I called Sirius Satelite Radio to change my payment information (I'm set up for them to charge my card each month) and they informed me that a payment had gone through right before I called. I asked them if they could stop that, but didn't think it'd be an issue since they closed out my card...right? WRONG! Because it's a re-occurring charge, they don't need authorization everytime! So, I had to dispute the charge w/my bank and my account remains open.
The bank said if I stopped payment on these items, it would be $31 per transaction. Since I didn't know how they were coming in, it didn't make sense to spend more money. My next course of action is to file a dispute with the bank after the charges post (which will be tonight) I have to fill out a Penalty of Perjury Letter. She said that once the charges are reversed and they are deemed fraudulant due to my revokation, any bank fees will be refunded too.
So, that's where I stand as of now.
I got a PIF from National Cash Lenders, now I'm harrassing THEM for a refund of overpaid fees! I've submitted letters to CashNet USA and National Payday requesting fees refunds from loans with them over the past two years (none with them currently). CNU said that they are reviewing my letters and will contact me afterwards. We'll see.
That's all for now.

even if you stopped payment, they will still go in under different names though :(
is there anyone else at your bank you could speak to? perhaps the fraud divison?

Yesterday, my account finally was able to be closed...Yay! They tell me in the event that it somehow gets reopened, I just need to contact them and they will reverse payment immediately and take care of any charges. The woman I'm dealing with is very helpful. She checked my account daily and called me with updates this whole time. So, while I don't have much faith in the bank as a whole, she seems very much ready to help. I'm so happy to have that out of the way. (Phew!)
