BMG filed two civil judgments - Arizona

I have no idea but, I received a call today from a debt collector Proffesioanl Finance Company and they said I took out a payday loan on 3/2008 and they filed two (2) civil judgments against me in court I have received nothing from the court but it is on the docket and when I asked them who BMG was and the amount of the loan and information about the company they would not tell me they just said information was filed with the court. I was told if I wanted to clear it up it would be 420.00 to be paid in 90.00 or approx. 1800.00 if I would end up taking it to court.

Any suggestions ??????

When you say that it is "on the docket", does this mean that you have contacted a court and confirmed this? Or did this collection company just tell you that it is on the docket?

If you have actually confirmed (independently) that your case is on the docket, then I'm just not qualified to answer that, and will defer to someone else..

However, it seems fishy to me that they are continuing to attempt collecting and offering settlements and payment plans if they have already filed and gotten a court date... so if your impression that it is on the docket is just from what they told you (how exactly do you "file a judgment", anyway?), DO NOT take their word for it...

Demand that they send a dunning letter immediately, and request a physical mailing address to which you can send (certified w/ return receipt) a Debt Validation letter (which requires them to validate who the original debt is with, how much it is, and whether they are legally entitled to be collecting on it). Once you have sent that, they cannot legally continue collection attempts until that debt has been validated.

Whatever you do, and whether or not this actually has been filed, DO NOT UNDER ANY CIRCUMSTANCES admit to owing any debt over the phone!
