Hello. I am currently being contacted by CCS & Associates claiming to be an attorney's office and collecting for CashNet USA on a payday loan I had with them in 2007. I have not received any written collection notices at all. I asked for POD and she told me she did not have to send proof. I told her until I received proof I wasn't responding one way or another. She tells me she has a "summons number" for me to refer to. I know I have paid well over the principle due to CashNet USA. However, since my payday loans are so old (2007) I no longer have any records of payments or contracts. Is this a legitimate collection agency and if so, what can they do legally in the State of Texas for collection?


A google search for CCS & Associates doesn't pull up any collection agencies with that name, but they could exist. If they will not give you proof of the debt you shouldn't respond to them.
Legally, in any state, if they have been assigned the debt by CashNet, you do owe money, the Statute of Limitations hasn't expired, and you don't pay or work out a settlement, then they can take you to court and sue you for the money under breach of contract. In addition, giving you a summons number is not proper procedure for notifying you and they should know that. If you are sued then you should be served according to the law in Texas, and given an opportunity to respond to the summons.
