I received a call from CAC Financial. When I called back they tell me they are not CAC Financial and that they are attorneys and that I owe them $2600 for a payday loan 3 years ago. This is the first I've heard about this. I only recently closed a bank account that I've had for over 3 years. They tell me they will have me arrested and I can go to jail for 10 years for check fraud, theft by deception. I requested verification of the debt and the original amount and was told it is not their job to provide me with that information. They offered to let me pay off the debt but that I would need to come up with a substantial amount first. Do I have any options, can I be arrested and go to jail for 10 years?


Hi, Isabelle. OVLG Attorney already answered your question in the original post you made. Please refrain from posting the same question in multiple places. It's confusing and slows down the process of you getting a good answer.

In short, no! You can't go to jail for a PDL, period. Ask these jokers to send you something in writing and then send a DV letter. If they refuse, there's your answer. They are trying to scare you into handing over your money. Don't do it.

You can NOT be arrested for owing a debt! What was the name of the pdl and what state are you in? If they are collecting on a debt, whether they be attorneys or not, they are REQUIRED by federal law (FDCPA) to send you a letter of collection via the mail, and they MUST validate the debt if you send wrtten notification requesting it! Don't admit to owing this debt, tell them you can NOT and will NOT talk about any alleged debt over the phone, then hang up.
