i had a collection agency call who when they first called only stated that they were calling from an attorneys office in Washington, he relayed to me that i need to send them immediately 800.00 for a 300.00 payday loan which if not sent by tomorrow will amount to 5,000.00--what are my rights i am willing to pay it off --it defaulted because i was layed off at the time am i not entitled to set a payment plan. The name of the agency was Upside Collections and he gave me a number to fax an apology letter stating that I was not trying to defraud the original creditor Cash Advance and send them 500.00 immediately of which I do not have right now. What do I do

did this person sound foreign?the reason i ask is because your post is exactly like alot of the scam in INDIA calls.the inflated amount.the faxing of a document either admitting to or apologizing to the collector.the immediate payoff like the same day.it just sounds like another US NATIONAL BANK,or AFFIDAVIT CONSOLIDATION SERVICE.btw the creditor just plain CASH ADVANCE is the name of the supposed loan place.do not pay them a dime.in fact they broke the law with their threats.file a police report.then file AG,and FTC complaints.then hang up on them.the more i read your post.the more i'm convinced it is the scam in INDIA using a different name.

I had been receiving calls all week from this company. And they refused to leave a message. So today David of Upside Collection Agency telephoned and I took the call. He begin to tell me that I have outstanding debt from an online payday loan (online) for the amount $400.00 dollars but will settle for $600.00 (Um does that sound right)

Then he kept over talking me when I tried to ask questions. So I listened. Then I said David! Are you done speaking? What is the name of the original creditor that your speaking off? What documents can you send to me to validate that I owe this money?

David proceeded to tell me that since he is in the legal department he does not have access to any of that information. (Once again, does that sound right)

He asked how much I had today to settle the debt? He suggested that I go an get a Walmart prepaid card and load money there and call back with the card number so that he was able to pull the funds off. Then each pay period I load money and they pull if off until the debt is collected.

Now, He can not give me any information on what company he is collecting from, he is asking for more then what the original amount is for. When I asked him the agency address he refused. He tried to give me some sad azz speech about he is new and trying to prove himself and I need to call back today with the information that he needs. I told him you cant' provide any proof that I owe this debt! Why would I give you any money to settle anything?

He said he will call me tomorrow and I should have the information. I said you can call all you want, but your wasting your time.

Scam writing all over this!

Just Google the name 'Upside Collection Agency' and you'll come to know who called you. They are a scam. The only thing they know is threatening and scaring people to make them pay. Do as Paulmergel has advised. File cases against them and the next time they call, tell them that you've filed against them.
