As per 28-46-402 of Idaho Code, "No person shall engage in the business of payday loans, offer or make a payday loan, or arrange a payday loan for a third party lender in a payday loan transaction without having first obtained a license under this chapter. A separate license shall be required for each location from which such business is conducted."
One Step Cash is not licensed to lend in Idaho. After discovering this, I notified the company that I had actually overpaid my debt by about $90, with renewals, but was willing to waive a refund in exchange for marking the debt paid in full. They didn't respond, so I assumed the company accepted my terms. In late May, I received notification from National Recovery Services that they are collecting this debt. I explained the loan was illegal and paid, but they have reported this debt to Transunion and persist in contacting me despite requests not to, which is violating the Fair Debt Collections Practices Act. I feel both companies are acting illegally in this matter. I know I can sue NRS for violating the FDCPA, but is there some way I can force either company to remove the debt from my credit report and give written notice of settlement? I have reported both companies to their respective Better Business Bureaus and notified them I have done so.
So, is there anything else I can do? Thanks for any help.
