PLEASE HELP ME! The stress is killing me!

I have 4 PDL's (TN) I am tring to pay now. 2 are with banks (must pay back-took bankruptcy in 2006-do not want to undo the last 4 years) 1 is small (I can eventually pay them off) But I have one with PayDay1One that I must default on. There is no way with recent developments that I can pay them off. If we went private I would be glad to go into the reason/reasons in detail. What are the repercussions? Will I have to go to Court? Will I be served a summons? Will it affect my Credit Report? I have already closed and reopened a new bank account. I have not updated PayDay1One yet with the new account # yet. My bank charges no ISF fees on closed accounts.

Also....I posted this ad yesterday (under my registered screen name) it was listed and now it is gone. Why? The same thing happened last week (more detail, said it had to be approved???? I never heard anything)


If you default on a loan you can be taken to court by the lender or their authorized collection agency to collect the debt if all other collection efforts have failed. In order to sue you properly the creditor/collection agency must properly serve you with a summons and allow you time to respond. Under TN law (Code of Civil procedure section 7.4 et al), anyone in the household over 18, even if that person does not owe the debt may accept the service of process.
Defaulting on a loan always has an impact on your credit score.

PayDay Loans are like loan sharks. Is legal aide available in your area? They normally offer legal assistance for little or no fees. (Senior citizens can get free legal assistance in many states).

Best thing to do is keep an open line of communications with PayDay1 - talk to the office manager, explain your situation. You want to avoid a lawsuit if possible. Are you judgment proof? i.e. rent rather than own home; making car payments; no visible assets?

On a side note, spend some time in prayer or meditation every day. When you're feeling stressed, get outside and go for a walk. (Or if its too hot - hit the mall!). Visualize the outcome that you desire rather stressing about situations that haven't happened or you can't change. There are millions of people in your boat right now - if you can cope with the stress you'll be better able to make wise decisions.

It seems as though I have replied to one of your posts before. To avoid reposting the same information all over again, did you already begin a topic about your payday lenders? It seems to me that I may have determined whether or not PayDay1One was a legal lender?

This is what happens when you post multiple threads, it becomes confusing not only to you, but also to the Moderators and other members who reply. We spend a lot of time researching these companies, but it becomes time consuming if we repeatedly answer the same questions in different threads, for the same member.
