You need to send them a cease and desist letter via fax or certified mail in order to get them to stop calling your work. Those states that allow garnishment do not allow anyone except the government to garnish your wages without a court order.
The fact that your payment via your debit card did not go through would not be internet fraud as far as I am aware, unless you sent them the information knowing you didn't have enough money in the account to cover the debit.

they don't take payments by mail because they are an illegal internet lender.a couple of questions.
how much was borrowed
how much debited before default
state you reside in
you see as being this place is illegal you not only owe the principle, but anything in so-called fees goes towards the loan.for example:
you borrow 300.00 they debit twice for 90.00 you only owe 120.00.please do not be swayed by illegal threats, because that is what they are.illegal threats.file a police report for the calls, then file AG,nd FTC complaints against everest.try to answer my queries as best you can.you will suprised at how little if anything you actually owe.

i live in florida.....I borrowed 300.00 and after i got my checking accounty cleaned up i closed it....before making a payment. Which i got in contact with them and told them. But i called and could never talk to anyone. and they started calling me at work...Months later........I have not recieved anything with there name address nothing just this "colloection agency" started calling, I looked up the number and it was listed to a Professional Debt Management 7007 NE Parvin Rd Kansas City, MO 64117.

What was the name of the original lender? If the original loan was illegal then all they can collect is the principal.
You should also send them a verification or validation letter to make sure the collection agency has the legal right to collect the debt, again via fax or certified mail.

so you are saying they debited nothing at all?okay that is still doable.as OVLG attorney advised send PDM a DV letter send it certified mail return receipt.they can't continue to call until they can validate.fat chance of that as in florida these loans are non-collectable,and non-enforceable.meaning technically they can't do anything to collect, but call.the DV letter should take care of the bottomfeeder collector.i understand you want to pay,and we push for that.however if a lender,or collector wants to break the law.then they get what they deserve...nothing.either they ackonwledge you only owe 300.00,and let you send in payments,or they get nothing.

you gave me the info for PDM that is who is collecting right?then send them the DV letter.also let your human resource person know a scumbag is gonna be calling.that will take care of that.the address you gave for PDM is correct that is who you are dealing with.not everest.they sold it to PDM.i hope this clears things up a bit.

I received the following response to my CD letter today from Everest. Mrs. Miracle, I respect a consumer who researches the services to which he/she uses. With that being said when you applied for and agreed to the terms of the loan it would have behooved you to read the complete contract you were agreeing to. You are a citizen of the state of Kentucky, however the contract was not made in the state of Kentucky. The contract was completed via the World Wide Web. The governing law (clearly outlined in your contract) which you agreed to by your legal e-signature is based in the isle and providence of Nevis West Indies Bahamas. With all the information at hand I am still willing to work out arrangements for the balance that is still owed on your account. You may contact our offices 8am-5pm CST Monday-Friday. Our toll free phone # is 1-866-321-6114 option 4. If no contact is made within a reasonable time the account will be sent to a third party collection agency. I know the laws in my state trump the laws in Bahamas. Do I respond back to that effect and send the quote that the KY DFI regarding the fact that they have to be licensed in KY? Or do I just give up. My total loans (yes 2-- ugh!!) with this company were for $1000 and I have paid $956 in fees. Any suggestions??
