ERS Collection for e payday loan

Has anyone ever dealt with them? My sister told me yesterday that they called her looking for me. They left me a voice mail saying they left a message with my mother (they gave her full name). They said if i didn't make payment in full by some given time then "paperwork would be sent to my employment. I kept asking her what she meant and she got mad and started yelling "do yo want to handle this out of court or not?" I told her i wanted to see a letter and them we could talk. She emailed it to me Nd kept saying she wanted to male sure I understood the situation. When I told her i asked e payday loan for a mailing address and they wouldn't give it to me she says "well we own this debt now" is this s legitimate collector? How should i handle this? I told her to never call my mother again and she said they were sell within their rights to skip trace. I hate all of these people.....


ok first of all, if they are legit, they're suppose to tell you everything you need to know about them and their costumer which is the company you supposedly owe to.Ask for address, phone, name of the person calling you, costumer or person who sold debt, amount. if they don;t give you all that, then they're not legit and its a scam, don't be scared! there are many out there! if they are legit and make sure you really owe this debt and contact the company you owe directly and ask them to verify the debt, date and amount see if it matches what the collection agency told you. If everything is correct and you do owe the debt, send Cease and Desit letters and ask them to only contact you either at home or cell phone and no one else! ask for payment plans and they should take what you offer them! don't take no for an answer, if they're legit, they usually take anything. DO NOT come to agreement with them by phone, do everything in writing, that is the C & D letter for. don;t give them your account info no matter what! some will say they don't take mail payments, well too bad for them because you have the right not to give them your account info. if they want to get paid, do it by mail and have them state that in the letter and keep it for your records in case you have to report them! NOTE: when you come to agreement with them, tell them you will only pay them if you get your info removed from the credit report when you're done, in other words: PAY FOR DELETE. now, they will tell you( and i know it by heart): yes, when you're done paying, we're sending you a "paid in full letter" and you can send it to the credit beareu. trust me that won't work! the only ones that can remove your info from the cedir beareu is them or the original company you send the letter to so make sure they agree to that before you make any payment! i wish you the best and good luck! don't let them intimate you.

As far as sending paperwork to your place of employment, it's possible, but, what they are probably referring to is imposing a wage assignment. Most Internet payday loans write into their contract a wage assignment which states you agree to allow them to attach your wages should you default on this loan. The good news is, it is revocable at any time, so, all you need to do is send them an email that says;
I hereby revoke any and all wage assignments I may have signed with your company, you do not have permission to use this wage assignment. I have sent a copy of this revocation to my employer, so any attempt you make to obtain a wage assignment with be denied.

This same lady keeps calling me. She's pretty much harassing me and keeps saying paperwork will go to my employer. I have her email from where she emailed me so I may email her back and say I only want to communicate in writing.

And i thought collection agencies didn't issue garnishments only attorneys? And i think it's funny that she keeps saying paperwork like she doesn't know the name of the document.

I am really getting sick of being harrased. Does a c and d letter mean they can't call you?

It isn't a garnishment, it's a wage assignment. I explained that above. A garnishment isn't the same thing, it can only be obtained with a court order. Read my post above on how to handle the wage assignment, if you don't send that revocation they WILL attach your wages, because you gave them permission when you applied for that loan, that is why it's important that you send an email and revoke it.

sometimes,but you have to inform them of this.i have heard instances where someone bought that up to the collector,and they dropped it and sent it back to the pdl.so try that.if the ollector is legit they will do the same.
