I live in Washington State. I have 1 store front loan, which is not in trouble. I have 4 loans on the internet through:
1. First bank of Deleware : Balance: 647, original bal 700 + fee
2. Brookwood loan : Balance 1000.00
3. United Cash Loans : $390, just been paying the fee so balance is the same
4. HudsonHawk : balance $260 been paying the fee, no balance change

Something came through on my bank account and put me in the negative and I am going to my bank to see what it was (it does not show, just shows the NSF fee) and my pay day is Friday. Stopped my direct dep because all these loans will attack and take most of my pay check. Sent them all emails and asked that they take me off the ACH automatic debit for these loans. I have been going through some serious health issues and on and off medication, in and out of the ER and missed some work, I am behind on my Rent and have two teenagers to get ready for the start of School. I am so stressed and don't know what to do, these lenders are not very understanding and I have always paid on time up till now. I don't want to not pay them, and have every intention of paying them off but can do it all at one time.. I am the only one working in my household, husband is laid off....and run out of unemployment.. Any advice would be greatly appreciated.

Have you sent a cease and desist letter revoking their authorization to debit your account?

First Bank of Delaware I believe is backed by a bank, so you can work with them. I highly doubt the other ones are legal in your state. Go to your state's department of banking and finance, they will be able to tell you whether or not the others are legal in your state.

I am currently fighting with unitedcashloans myself...so if you need any contact information, just let me know.

Don't beat yourself up, everyone here is very supportive and a wealth of information. You can get out of this mess, I have a couple more to deal with, then I will finally be free. Hang in there.

I am working on a revoke letter this evening..been at the dr all afternoon. I did contact Bank of D, via email and explained my circumstances and they said that the debit will run through as set up in the original contract. Couldnt get ahold of anyone with hudshawk, left a msg, called unitedcashloans and they said that there was nothing they could do. Brookwood loans put my payment off for me a bit.

I had my direct dep taken off and when I went in the bank this afternoon they said the branch manager wouldnt be in till tomorrow and I should talk to him. I am going to ask for a hard hold dep. only for my account and on payday (friday) I will close my account, once I can get the balance out of the minus.

Thanks for the response. I did try to look up these lenders in the state of washington and none of them came up as legal in the state of WA. Go figure.

Washington has what I think are really good PDL laws. If they are licensed, the are required to allow you to enter an installment plan at ANY time. If your loan is $400 or less, you get 90 days to pay it back. If it's between $401 up to $700 (the limit), you get 180 days to pay it back. They cannot charge you any additional fees. If you miss a payment, you have 10 days to make the payment before they can declare the loan in default.

If they are not licensed, they could be totally out of luck. RCWs say that any PDL loan given illegally is uncollectable.

Just want to share that bit of info. You can find it on the Access Washington web site.
