Rent-a-Center pdl texas

We have a payday loan at Rent-a-Center storefront for $784.33
We couldnt make the last payment so they tried to cash the check.
It was returned for NFS and they are calling saying they dont want to have to send it to the DA's office, but they will.
While trying to reach us they called my sister-in-law and mother-in-law and told them it was reguarding a bounced check.
Are they allowed to tell my in-laws about our financial business?
Can they turn the check in for criminal charges?
