So it begins. Emails sent to PDL's
Date: Tue, 08/17/2010 - 17:07
I have posted numerous times so I have decided to put everything that has happened to me in one post. I reside in Arizona and found out that PDL's are illegal in this state. I closed my checking account last week and that was the biggest relief I have had in quite awhile. There is no worse feeling then logging onto your checking account just to see how much your account is negative that day. My advice to anyone out there is CLOSE YOUR ACCOUNT ASAP!!! You will sleep better at night. Make sure you read the post about closing your account that is "stickied" on the front page.
Today I sent out letters to all my PDL's stating the fact I know the loans are illegal and I will agree to either pay off the principal balance or in some cases I am entitled to a refund. Here is the breakdown of my loans"
Great Sky Finance
Original Amount $300 paid thus far $780
TheCashSpot.com
Original Amount $700 paid thus far $1,155
SureAdvance
Original Amount $400 paid thus far $636
Sandpoint Capital
Original Amount $300 paid thus far $180
FBDLoans.com
Original Amount $500 paid thus far $86.50. I did find out FBDLoans.com is a legal lender in my state and I am trying to workout payment arrangements with them.
If anyone has experiences dealing with any of these PDL's please let me know. I will keep everyone updated on how it is going on my end.
Cheers!
Rugger

That first step is always the hardest, isnt' it? But I can tell you from personal experience, when you start to see the light at the end of the PDL tunnel, it is one GREAT feeling. I've not dealt with the companies you mentioned; however, as Paul says, you're no doubt going to have to deal with the PDL's telling you all kinds of nonsense and attempting to threaten you; they all use types of semi-legal jargon, their bottom feeder collection people call up with all manner of official sounding names, etc. Just hang in there and if you have any questions, this is the place!! Keep us posted.

I got my first email response back today. I paid Great Sky Cash $780 dollars on a $300 dollar loan. This is from Great Sky Cash:
As stated in the contract you signed with Great Sky Cash, we are not a state by state module. We abide by the pay day loan laws of South Dakota. When you signed this agreement you also agreed to abide by these laws. I will also be happy to provide your signed contract to you or anyone who needs it. If you are having financial hardship, we will be happy to put you into an affordable payment plan where you will not incur anymore fees.
that is what i'm talking about.BIG SKY is illegal, and that is so
that is what i'm talking about.BIG SKY is illegal, and that is some of the BS they try.your state law prevails.do not buy this crap as that is what it is crap.also an e-signature doesn't hold water.again they are full of it.file AG complaints against BIG SKY,and let us know who else tries to baffle you with BS.

Listen to what Paul says; these outfits are experts as throwing around terminology which will scare people into sending them money. Too, if they say they're willing to work out payment terms (ha!!), you can bet they're probably trying to get your new bank account information. I've even had PDLs' send me emails saying I'm such a good customer, they'd like to give me MORE money! And - guess what? - all I need to do is send them my checking account info! ;)

I would simply resend what you sent them to begin with (via email) and add that you've received their response, you know they are incorrect because your state law prevails, and you'd like your PIF letter along with your $480 refund.

Is there anywhere on this site that has a form letter I can use as guidance in drafting my letters to the AG's, BBB, & FTC.

Your best bet is to just state the facts of your particular situation. Use your own words, use dates, times, figures, etc. wherever relevant. Feel free to post a draft here for critiques - just be sure to remove your personal info.
Most AG, BBB, and FTC sites have a form you can fill out online to lodge your complaint. Once you get the language the way you want it, you can simply copy and paste it from place to place.
You can check out Shazz's "dealing with illegal lenders" thread for some samples to use as a starting point.

great info! I told one of my lender's that it was pointless to be debiting my account causing more overdrafting fees leaving me with nothing to pay them! it didn't make sense, so they agreed to stop the debit payments hehe! and i put the aCH blocks too!haha

Great Sky Finance is the only one who has emailed me thus far. Here is their latest:
You will not be receiving a refund from us as everything is outlined in the contract you signed and agreed to. However we will accept what you paid as a settlement on your account. This will show as a settlement on your credit report and to future loan companies.

I just had 2 run in's with Great Sky. I called to extend my $300.00 loan, the finance fee was given and on my payday the loan amount withdrawn was for more. Next payday Great Sky had a computer malfunction so instead of taking out the money on a Fri they took it out on a Monday with no notification that there was a problem. Unfortunately I don't check my bank account on a daily bases, I never thought when I went to use the AMT over the weekend that GS hadn't taken their money out so it caused an overdraft. When I called them their attitude was you need to do better banking and there is nothing they can do. I did something and put a block on my account. I sent them an email withdrawing my ACH and now after reading several of the comments here I see that I need to send them another letter letting them know I have no intentions of paying them any more money. The finance charge from May 2010 until now weigh out weights the $300.00 loan.
