Collection Company Contacting My Employer?
Date: Wed, 09/01/2010 - 09:44
Hello,
I live in Illinois took out a PDL with Titan Group. The Original amount was for $250.00. I ended up paying back a total of $275.00 to Titan before I closed my account at the bank. I sent out all of my ACH Revocation Letters and Wage Assignment letters to this company and even demanded a refund of $25.00. Now I am being contacted by a collection agency/ "attorney" called Locke & Butler. It appears that they are actually ACRNF doing business under another name.
I get emails twice a week from this company and I responded with a C&D letter. I started getting phone calls at 8am & 9pm and each time i asked them not to contact me because i dont know anything.
Now they are leaving voice messages on my employers general mail box saying that i need to contact them about an important business matter in upstate New York?!?!?! They have gotten through once to my boss and another time through to our receptionist. I told them not to call me at work and they still continue to do so. I filed complaints with FTC, BBB and my state AG. Is there anything else i can do to at least stop them from calling me at work??

Have you had a sit down conversation with your employer to let them know what was going on? Are you in the least bit understanding of the situation? Reach out to Human Resources and let them know about it. Most companies won't have a set procedure on how they deal with the phone calls coming in but they shouldn't be counted against you.
If the calls have continued long after you have submitted C&D notices to the callers, you need to get the local police involved. Have an officer come to your home or place of business and sit with you when you go to place a call to the collector. Advise them then over the phone that they are no longer allowed to call you at home or at work and make mention of the many C&D letters you have since sent.
If the collector balks at the the request or starts getting confrontational, you have a member of law enforcement with you to step in and notify them that you have put in a complaint about their company. At that point, if there is any further contact from them a subpeona will be issued to the supervisor on duty.
At that point they can't simply just hang up and say it never happened, not after getting a police officer involved.
Furthermore, Illinois is a one-party state so you have the ability to record the conversation (without the caller's consent) and provide that as evidence that you are being contacted by the company repeatedly despite being sent a C&D notice.
Also, verify if the collector is actually licensed. They have made quite a few violations of the FDCPA. You could take the collector to court and get something out of the whole experience, not just $25 for the refund on your overpayment.
