Payday Loan Yes and Law Offices of Vincent P. Cignarale

I am looking for assistance in dealing witn these two 'organiztions,' for lack of a better term at the moment.
Earlier this year, I got into an auto accident (was riding shotgun). This particular event made a negative impact on a lot of areas in my life, my finances being one of them. Out of desperation in paying the bills and such since I'm the only person in my house that has a job, I took out a loan through this company, among others. That is a huge mistake.
I was not able to pay them back, I'll admit that. However, my finances has improved in a small way since then, so now I'm at the "let's look at who I owe and pay them back" phase of fixing my mess.
Currently, I have other loans that I'm paying off, however this is the only one that is causing me issues. I believe I owe them about $700 I think, however that is with interest. I'm not sure of the principal since they are not disclosing that with me.
While I was at work earlier today, I got a phone call from the Law office, of which caused me to feel uneasy. Not because "oh it's a debt collector and I have no money," but just a general feeling that this particular group is shady. I figure I would do this the way I have done with previous companies: write a letter to the original creditor, explain my situation, and come up with a payment plan/arrangement. Not with this law office.
It was like pulling teeth, but not only did I request to cease and desist to contact me at work, but I also got the original creditor information. I tried to contact PDLY, however it's past their business hours, and from what I have learned through experience with the call with the (shady) law office, I prefer to write rather than to call, however I only see a fax number for them and not a mailing address... at least one on the stateside.
The last thing I need nor want is for these people to garnish my wages. As I have stated, I'm the only person working in my house, and I just got myself in a somewhat financial stability. I'll admit that I got the money and I do owe them, I want to pay them back, but not through ACH. I prefer the old fashioned way (checks... they've been collecting dust anyway) or through my debit card.
Is there a way to communicate to them that I'm willing to work something out with them to pay them back, and halt any kind of action they can muster against me? At least I'm making the effort to pay them back! And what kind of disturbed me was the guy from the law office told me that going through the original creditor would be useless, and they won't accept the payment. I'm a little green at this, but I know enough to recognize a lie when I hear one. This is a lie, which indicates to me that this law office is really really really shady.... or they just know how to talk tough without some real experience and/or knowledge.
Anyway, enough ranting... I need help... what else should I do to contact them and work this out? They are my only difficult company to deal with and I cannot afford them to touch my paycheck!
I hope I made sense in this... I'm just so distraught and my mind is as scrambled as an egg right about now....


As I thought, Payday loan yes is NOT licensed/legal in your state, or anywhere else for that matter. Check out the BBB for information on this 'law firm' that called you, terrible reviews to say the least.

Anyway, they can't collect this because it is an illegal loan to begin with, so, the next time they call you tell them they have 5 days after their first initial contact with you to send you a dunning letter (letter of collection) via the mail, and until you receive it you are informing them NOT to call you at work or anywhere else again, if they do you are going to file a complaint with the FTC against them for not complying with the FDCPA, they may be subject to a fine. Also tell them they are trying to collect on an ILLEGAL debt, by no means admit to owing a debt to a voice on the phone, EVER.

Keep records of ALL communication between you and this law firm, try to get the name of the employee, note the date and time, phone number they are calling from, etc. You will need accurate records when you file complaints, and you can easily do this online. Eek!!! I figured they were shady! My instincts are never wrong! Thank you for the info!

And question... just for future reference (**IF** I ever consider a payday loan... after this experience, however, that will not be the case for a long time!), how do I check to see if a PDL company is licensed in my state?

For the most part, stay away from Internet loans, any personal information you share on the Internet is NOT private.

Oh, I've learned my lesson to stay away from PDL's in general, not just the internet.

And I did as you suggested... sent in my complaint to both companies. With Payday-loan-yes.com, I sent an email, with the 'law office', I sent a certified mail. Both of them are the same letter anyway. So we will see what happens with these two 'companies.'

I had taken out a PDL with PDL Yes. I paid more than I borrowed and following the advice on here closed my account and sent them (and many others!) letters stating I was paid in full. PDL Yes was relentless in trying to collect more money from me. They called my home, cell and place of business. They talked to my boss and told them about the PDL - embarassing!! Every day - sometimes 4 x times a day they would call and threaten. After a few weeks I just kept hanging up on them and I haven't heard from them in a few months. Hang in there. They are so illegal it isn't funny. They will not tell you their mailing address, they only want your bank account info. DO NOT GIVE IT TO THEM. They are crooks. I would follow the advice given on this forum - these people are awesome!!

^^^ Thanks... and as you have said, they have not provided a mailing address. Oh well... no address, no payment, no exceptions. And if they try to say that I have not attempted to settle, well... they have another thing coming!!!

Now I have to go through another process of filing complaints and such... because if I say that I'm going to do something, then I'm going to do it. It's a pain, but I know it's worth it!

It's easy to file complaints online, just make sure you state all the facts, good complaints get better results.
