Hi, I'm new to this forum and I think it's WONDERFUL what you all are doing here. I took out a Check n Go installment loan for $2000.00. This is my first loan of this type and I really regret doing it. When I first made this decision my job was offering unlimited overtime so it was easy to handle the payments but these last few months it's been extremely difficult to keep up since they have cut overtime completely. I am now behind on all my bills and recently had to move out of my apartment because I could no longer afford my rent. This loan was a HUGE mistake and I really need to stop them from debiting my bank account. PLEASE help. I get paid again on 10.29.2010 and I REALLY need my full check. I don't know where to start. PLEASE help.
**Also, I applied for the loan online using my Illinois address and information (because my license is still registered there), however I live in New Mexico.


You need to send them an email revoking their right to debit your account, date it, and take it into your bank with a copy of the EFTA laws, in that letter include the fact that you have informed your bank of the revocation so any attempts they make will be denied. They (Checkngo) may try to convince you that their contracts states you can't revoke their right to receive payments via electronic transfer but that isn't true, the federal law (EFTA) states that you may and that trumps their contract.

Anyway, in the email outline a payment plan you can afford and agree to send them payments via the mail, inform them you need a valid address where to send payments, then follow through with the payments. If bad comes to worse and they refuse to accept those terms, contact their corporate office, or better yet, send a copy of the revocation to their corporate office also.

Stopping their right to debit your account is the easy part, getting them to accept a different payment plan is quite another. However, it sounds like you are desperate to gain back control of your finances and this is how I would go about doing it.
