I became over whelmed with payday loans and cannot not pay them right now.  I realize that payday loans are an irresponsible solution when you are already having money problems and I have paid some of them well over what I borrowed in interest.  Once the problem started to cause me to not pay rent, electricity, etc.  I just shut my account down, sent the companies a certified letter stating that I am unable to pay at this time and fielded the calls.  One company in particular, has hired someone who says he is a lawer and someone who  is a process server to all my job and tell them to tell me the process serveris on his way to serve me with a summons for check fraud and the less than desirable things that will happen, such as being jailed.  This company is MyPayDayLoan.com.  First, his this legal entity in Texas or even the United States.  Although I intend to pay the loans back, with some negoitiation, I would like to know how far these companies can go.  Is there a place I can go and check of the authenticityof these companies?



Debts are civil, not criminal.  You cannot be arrested for the payday loans.  Go to your state department of financial institution to determine if the lenders are legal.  If illegal, you are only morally responsible to pay back the principal amount of the loan, no more...no less.  On this site, click on Forums, then click on payday loan help, then click on sticky on how to deal with unlicensed lenders.  Follow every step.  If your loans are legal, you will have to default, be sent to collections, then call corporate office to set up a payment plan.  If you have any more questions, ask them here.  We are all here to help!!
