First off, you posted just fine, so not to worry, we got the gist of your story. My best advice to you is to put a timeline together here. Write out whom you spoke with, dates, times, etc. Get NAMES if at all possible. If they do try and do something, you are going to have your ducks in a row. How much have you actually paid on this loan with rollover fees? Was the original loan for $200? You might have already paid this loan back and not even known it!
If you do still owe on this loan, if they are a storefront (and I think they are) I would even send a payment via money order or certified check (copy it!!) to the storefront where you took out the loan. They are not going to send it back, they want your money, trust me.

I have been keeping track of as much as possible. I have save all the emails from Sally Mulky, all mail and I even saved my phone bill showing just how many times I've called them.. The original loan amount was for 300.00 and then with the interest we owed 354.00 and we were paying 54 dollars every 2 weeks (a total of 4 payments) and we had to pay our rent so it was either pay this loan and not have enough for rent or cancel the check so we can pay rent..so we cancelled the check and ever since we have made attempts to pay them but they keep giving us the run around and I am terrified that they are going to end up garnishing our wages for even more than what we owe because they played so many games with us. and that customer service they have is so bad..i really don't understand how they can be allowed to talk to people the way they do. i thought about just sending a payment directly to them but then i thought what if they try to play more games...or is it not possible? i've never had this sort of issue before so I don't know just how royally they are able to screw me..and i was googling for answers heh and came across this site so i figured hey...why not try.

I tried to go into Check Smart today in Orem Utah and give them $100.00. They refused to take my money and told me to stay right there in the store the police would be there in 15 minutes to take me to jail. I couldn't believe this and I had my 10 year old son with me. They also told me that I was a bad check writer and they were going to prosecute and have me thrown in jail. I was supposed to pay the entire balance today but my employer stopped our year end bonus because of the economy. I did close my checking account because it was going in the red because of my paycheck not being deposited into my account. I am a computer programmer and we get a monthly bonus. We also get a yearly bonus that is 10% of our salary. This is the main reason why I took the job here. They have always paid the bonus on time and have never canceled one until now. Three days before pay day they brought us all into the office and told us because of the economy that they just didn't have the money to pay us this year. I was thinking about the payday loans that I had taken out depending on this paycheck. So in a few days the checks started bouncing and I knew if I didn't do something that I would owe the bank thousands so I closed the account. I went and talked to all of the check loan companies and was able to work out payment arrangements with all of them except Check Smart. When I called Check Smart and tried to explain they called me a bad check writer and a felon. I told them that I wanted to come good on this and they said they didn't want my money they wanted me in jail.
I do know enough about Utah law that if you do write a bad check and the account is closed you have 7 days to pay unless the company makes payment arrangements with you. Check Smart has taken 3 payments on this account before they stopped and told me that it was taking me to long and wanted all of the money now. I don't know what to do and was looking for a local attorney that might be able to help when I saw this post and had to respond. If anyone could help please let me know. I am married and have three young children ages 10, 8, and 3. My credit problems started two years ago when my wife was diagnosed with non-hodgkin's lymphoma. We had terrible insurance and the hospital bills ate us alive. Our kids haven't had a Christmas in two years and with the big bonus coming in I decided to give them one. IT looks like that was a big mistake. My wife still can't work and is still having a lot of problems. I want to pay all of my debts but there is no way to pay the entire bill. I can't be sitting at work and the police come in and arrest me. I would be in jail and my family would be homeless. Crap I make OK money but these check loan payments are eating me alive. I can't file bankruptcy either because of my job. If someone can help please respond.

I did find the Utah code on dishonored checks. You can read it here but it is a lot of information and points to a lot of other codes and laws etc.

I am not familiar with Utah laws either but if you do a search on the internet, I see there has been a lot of research done on payday loans there by the Utah Consumer Lending Corporation. Perhaps they could give you someone to contact or you might try your state representative. I know here state reps can be counted on to help with utility companies, etc. Since there seems to be some legislation around Utah payday loan companies, it might help to contact your state rep and advise what has happened especially given the fact you were threatened in front of your son. I realize it could be a long shot but it might be worth a try.

How much do you owe them? Check smart is the WORST store front there is. They will call you everything in the book and call you lots of times every day. I defaulted with them about a year ago. It was not FUN at all, however I just kept telling them I could not pay the entire balance at once, they kept saying they would not take payments. This went on for about 2 months, finally they called and asked what kind of payments I could make:) I ended up getting them paid off in 4 by weekly payments. The store managers get paid a bonus on how many loans pay back on time, so they are trained to get nasty...The corp off will also get nasty then they will turn around a bit. It is nerve racking, but hold your ground and SAVE SAVE SAVE anything you can to pay them off ASAP. Good Luck Reny

Well i know things about thing with this company and managers DO NOT get a bonus for collections, they get reamed by the higher ups. and as far as payments go as long as you offer them at least half or more one payday and half the next they will usually work with you. just dont dick them over on your promises to be in. all they want is to get paid back. they give yo money to borrow and ask for it back plus interest. if you cant pay it back don't borrow it. but legally you signed a contract stating you would pay back under the terms stated...not much room to negotiate.:rolleyes:
