My Trials and Tribulations

Hi Everyone:
I just wanted to share my story with everyone. I was drowning in payday loans (I live in Indiana). The following is what I had borrowed and paid:
United Cash Loans: borrowed $650 / paid $1492 (worst one....I know)
Ameriloan : borrowed $600 / paid $944
Cash King: borrowed $700 / paid $756
Silver Cloud: borrowed $400 / paid $820
Plain Green : borrowed $ 900/ paid $646.30
Western Sky: borrowed $1500 ($500 processing fee) / paid $68
I was about to go crazy!! I was paying out more than my bi-weekly check to satisfy the fee. I was about to go to the attorney to file bankruptcy when a Google search pointed me to this forum! It saved me from filing!!
I emailed the letter provided on this site with some of the verbage replaced for Indiana regulations, and the following are my results:
UCL: Currently "looking into it"
Ameriloan: see email below
Cash King: PIF statement and refund of $56
Silver Cloud: PIF statement and refund of $420!!! :o)
Plain Green: letter of "no wrongdoing" and settlement offer of $253.70 paid in 6 installments
Western Sky: what a fricking mess!! Same as others I have read about here. They keep sending me my loan agreement and quoting "tribal" legalities
Here is the email I received from Ameriloan:
Thank you for your correspondence regarding your account. We are disappointed that you are no longer satisfied with your loan. However, the loan agreement you entered into with Ameriloan was and is a valid agreement, which is governed by the laws of the Miami Tribe of Oklahoma, a federally recognized Indian tribe.
In addition, it has come to our attention that the form you are using for your correspondence originated from a forum on the website http://www.debtconsolidationcare.com/ . Regrettably, posters on these types of forums tend to traffic in misinformation and mistruths. Often, forums of this nature advance the incorrect theory that form complaints and letters will absolve customers of the obligations set forth in the valid loan agreement entered into between the customer and Ameriloan.
Notwithstanding, Ameriloan takes pride in its customer relations and has reviewed your account to ensure that all debits and payments were in accordance with your loan agreement. Upon review, your transaction history shows that all debits and payments on your account were correct. As such, Ameriloan will not be issuing a refund on your account.
Should you have any further questions concerning your account please call our Compliance Department at 1-800-394-0089 Monday–Friday 8:00AM-3:00PM CST, or email the Compliance Department at compliancedepartment@ameriloan.com.

While my initial email may have been a form letter, I do not issue these lightly. Further information was gathered through the office of the Indiana Attorney General and the Federal Trade Commission.
No matter your reply, tribal lending or lending by ANY lender that is not licensed in this state is illegal and invalid.
If you will not issue my refund as requested, then a chargeback process will begin on the last transactions of my account which were done on my debit card. Since I am expecting the same reply from United Cash Loans (another of your companies), I will do the same there. I will await my replies from the Indiana and Oaklahoma Attorney General as well as the FTC with whom I have registered complaints.
Strange it is also that you will not issue a refund for overpayment whereas Cash King Advance and USA Money Shop would.
Anyway, my pursuit of this matter is not finished. I do appreciate the PIF letter.

So, I am not finished with Ameriloan and UCL. I am a bit concerned with CashCall/Western Sky. I have not checked my credit reports yet to see if there has been any activity on those with CashCall. I have not received a reply to my settlement offer with them so I don't really know what to do. I have filed complaints with the Indiana Attorney General and FTC over CashCall/Western Sky and will be contacting the Indiana Department of Banking and Finance to see if I can find any relief. I do want to payback any money I received from them but they seem to want the "all or nothing" approach and bully me into continuing my agreement with leaglease and scare tactics. Do I just wait or should I try to send them the installments? Do I wait for them to turn me over to collection and go from there?
I am just so amazed how easy these companies make it to fall into this cycle and trap. I was borrowing one to pay another and it just got so out of control. I just can't thank this forum enough for reducing my stress level and my ability to sleep better at night now!!
I will follow up on this forum and thread should I hear anything or receive further refunds.

what letter did you send? I have found a couple, and unsure which one to use. I am talking about for illegal PDLs.
