i did this ealier but not sure it posted. i received a email from sure advance. they said they are full licensed in delaware. they do not do business in va. but did make a cash advance to me pursuant to my request made in delaware via internet so transaction is legal and compliant under delaware laws. loan agreement presented to you on website in delaware after completing application for refinance . they want me to contact them about a SETTLEMENT on loan.please help how to respond to this. thanks for all your help.


Do not fall for that BS. If you have to lend in VA, you have to be licensed with the VA state DFI, no two ways about it. Revert to them in writing and tell them that:

a) You know your laws and your rights and whatever they are trying to convince you with is a load of crock,
b) VA laws state that a lender needs to be licensed with the VA state DFI to be able to lend legally and since they are not, they are entirely illegal,
c) being a resident of VA you are not subject to DE laws
d) You are not interested in a settlement, only willing to repay whatever principal balance is left (change this to a refund demand if you have overpaid) and if they are interested, you will pay them as and when you wish through a money order or a prepaid debit card
e) Any further BS or harassment will result in a promptly filed complaint with the VA AG, the DE AG, the FTC and the CFPB.

Thanks for all your help all the information is so helpful. Sent cash call letter probably be asking for more help
