I was not having much luck in finding out if Tremont Lending is legal in the state of Texas. Their home page says they are based on tribal land here in the US. I got a $400 loan from them and have made the following payments: $200, $168, $128 and $103 with a balance of $ 212.21. Thanks in advance for the help!

Any tribal lender is illegal in any state. You owe them nothing more, in fact they owe you a refund since you've paid over the principal. At this point you have two options - send them the letter in my "dealing with illegal lenders" link below, and tell them you aren't paying any further and leave it at that... OR you can request a refund. It's up to you.

You can ask them for the refund, as you have already overpaid them. But it depends on their discretion whether or not to return back your money. In this case it would be better for you to close down your old bank account and open a new one to stop debiting money from your account.

I am very appreciative of the help! The last payment was taken out of my account today so they won't be debiting any more money. I will try to get a refund for the overpayment. Hopefully I will succeed.

Keep an eye on your account anyway...they have your information, and you could see withdrawals you did not authorize..If it was me I would close the account and open a new one. so no one has access from that loan

I agree - best to shut down the old account and open new one not linked to the old one.. Did you already send the letter revoking ACH - if yes they will try to get more if they can..

I have not sent the letter yet, I did a stop payment with my bank. Should I send the letter anyway to Tremont?

Stop payment - Why? You should have just revoked their ACH authorization and informed the bank.. they have to allow. Stop payments cost money and don't insure anything - they will just run for a different amount, under another name even if they want.. The best way is to shut down the account completely and open a new one not linked. - the best practice is to follow the link on how to deal with - all of the steps in order.. http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html
