Please Advice

Hi Guys,
I got this response from one illegal tribal lenders (Big Picture Loans). I have paid the principal borrowed and in fight with them to mark my account as 'Paid in full'. This is their response -

'Please understand that The law that applies to situations where state and federal laws disagree is called the supremacy clause, which is part of article VI of the Constitution. The supremacy clause contains what's known as the doctrine of pre-emption, which says that the federal government wins in the case of conflicting legislation. We are following federal laws regarding your loan and we’re willing to work with you regarding the balance but unfortunately, we will not be able to dismiss the debt. Please reconsider working with Robert to resolve the account. You’re only 10 days past due at this time so we do have some time to work with you however, once the account is transferred to a 3rd party, any and all assistance that we can provide will not be transferable.'

Can anyone advice me on how to respond to this?

Does anyone know a company called Are they legal. I obtained a loan from them. That was before I know that they were not licensed in my state (TN). After that I revoked their ACH authorizations and contacted them to make arrangement to pay off the principal (I have already paid $300 for a $500 loan). But they rejected the offer and asked me to pay the principal+their outrageous fee. They are also kind of threatening in their emails (telling that they will report me to SCAN, and I will lose banking/check writing ability etc.). Any information will be highly appreciated.

Big Picture Loans are notorious for using tribal laws to defend their illegal activities. This is their standard response. Nothing to worry about it. Ask them to send you the email id of Robert. Ask him that you're not going a penny more to them. It's as simple as that.

Avoid their calls, ignore their mails, illegal payday lenders can't harass you. You have paid off the principal amount, now they can't interfere in your life anymore. If they still disturb you, file a complain to the state's attorney generals office.

Help I am in a similar situation with another company! This was the response back after i sent them an email about being an illegal lender. I did state i would repay my principle loan..Please help!!

Judging by your bank statements and the fact you have loans with at least 3 different companies, we understand that you are well familiar with the way that the lending market works.
CreditCube is a Tribal enterprise, wholly owned and operated by the Big Valley Band of Pomo Indians, a federally-recognized American Indian tribe and sovereign government. Any Agreement entered into as a result of this Application shall be governed by applicable Tribal and federal law. This is also shown on the first page of the loan documents that you signed.
This alone makes the contract that you signed completely valid according to the federal law in the US.

That being said, you received the loan on 03.08.2019 and it's been 1 business day since you received it.
We will refer to the email you sent us as a request to reverse the loan and we will debit your account for the full $300 tomorrow.

If you will not agree to be debited for the $300, we will consider your email as an admission to fraudulent activity on your end and will proceed with the proper treatment.

Please confirm that you agree to have your loan reversed tomorrow on 03/12/2019.

It's better you let them to reverse the loan. Why should you let yourself get into a dirty pool? You need 300 bucks? Borrow the amount from your friends or a credit union. Once you take out the loan, then won't allow you to pay only the principal amount. Remember that. They will always ask you to pay the high APR.

I recently got myself into the payday and installment loan tornado. I thought I was able to make the payments but paying these companies $600 a month while your principal isn't decreasing is hard to overcome for some of us. I appreciate the advise I have received here you guys have help a lot, much more than you know. I am still not sleeping well, still getting calls all day till trying to figure out what I will do if my wages get garnished but every time I come here I get home that it will work out with the payments i have suggested to these companies.

What hurts is some people judging others, maybe you have friends or family you can borrow $500 or $ 1000 from, not everyone can so to pass judgement on others is immature. If you are here feel free to help and uplift others. I think we all have recognized our mistake and trying out best to fix it, no need to judge others.

If you have borrowed your illegal loans from a lender, then your wages won't be garnished. I understand what you're implying. It hurts when people judge you. No one can understand your pain unless he/she is in your situation. What's important is to realize our mistake.

You're right. You should only pay the principal amount. There is no need to pay the outrageous fee. The loan agreement is null and void legally. Morally, you're only required to pay the principal amount. In your case, you need to pay an extra $200 to the lender. That's it.

Don't pay heed to what they're saying.

It is usually hard to find an honest loan company, I finally found what I was looking for inpayday-loans-cash-advance I do not know how they do it but every time I turn to them they offer me a deal fair and in accordance with the laws.
