I just received a call that they are going to start wage garnishments with a court order. Can they do this?

they are talking about a wage assignment.a real garnishment requires a court order,but that comes from winning a lawsuit which they can't do without a court date that you attend.get a wage assignment revocation letter to your employer asap,and know that a garnishment comes from them suing you and winning.again get a revocation letter to your HR/payroll person asap.

I am confused I did not give them permission (i don't think) to do that but from the samples I need to send it to both my HR and to the creditor? Correct? Thank you.

You probably didnt read all the fine print...it is there. Send the voluntary wage assignemnt to the PDL and your payroll department.

Well, they have stopped calling me at work, but continually leave me messages for a settlement etc...I have never received anything in writing from them as requested either via USP or email. At this point the stop pay at the bank is about to expire so thinking I need to pay another $25 to have it re done for another 6 months. I have paid them back all of the principal + so how do I get them to stop calling me?

you draft an ach revocation letter locate in soaplady's signature.why pay for a stop payment when EFTA section E is specific in regards to ACH debits.see a manager only and give them that letter.they can do that for nothing.btw the only way they will stop calling is by you not returning calls and filing an AG complaint against them.do those two things and continue to ignore them.
