1] The man I spoke to was rude and horrible manners... and customer service.
2} Demaning I make payment from a loan I took out in 2005
3} I have paid on this on loan
4} In the mean time I had closed my account {several years ago} and of course don't have the proof of payments... { I know I can call the bank and get my statements from 2005.}
5} This business Hasn't bothered to contact until 2008... WOW!
6} Know my balance is $5000.00 ....... JEEPERS
7} They said I can make a lump sum payment of $600.00... therefore I told them that I wanted to do my research on this.
8} I am home know and searched and searched my records and to my knowledge I don't have this company listed anywhere.... further more this company couldn't even give me a REFERENCE # to go..... odd???

First off, Welcome! Secondly, I can tell you that PDLs are prohibited in New York State. I don't know how long that law has been in effect, or if it even matters in this case. Perhaps you could clarify a few things. You state that you got a call from Cash Unlimited. You also state that you have emails regarding a cash2day4u. Is this one in the same PDL with a name change or are they do entirely different situations? You also list several other PDLs but I am assuming that they have been paid in full? Also, did you pay this particular PDL in full or is there still monies owing on that debt? Actually, it's pretty typical for them to not have too many facts. It has been my experience that the left hand doesn't know what the right hand is doing in the PDL world. If it were me, and I am "need to know" type of person, I would call the number given to me, ask to speak with a supervisor, and demand to know exactly who sent this phone call my way. My belief is that I can't adequately defend myself against an unknown factor. Once you have the facts (if they are even able to provide you with them) then you can go about a course of action. You have informed your HR department of the situation and they are well aware of what could happen. You could put something in writing to them revoking any wage assignments that should come their way. As far as a wage garnishment that can't be honored without benefit of a court document and I hardly think that will be happening any time soon. They can't even figure out who they are squeezing you for,much less go to court and present a valid case. I hope this helps some. If so, that would show what you borrowed and the remaining balance. Don't pay or agree to pay anthing until you know EXACTLY what you borrowed and what you have paid back. Maybe your bank can research the deposit and the debits to the loan. You may have to put up with the phone calls in the meantime but I would just tell them that you are having your bank research the transactions before you go further. Keep us posted.

It's Cash 4 You. Those jerk offs. No, there is no website for these illegal overseas bozos. This is most likely a "verbal agreement" - no paperwork - which is why you can't find documentation on it. These guys are the worst. They will call you 1,000 times a day (even if you tell them you are DEAD) and say illegal things and give illegal threats. They can do NOTHING. As long as they can no longer access your bank account, you're good. The only downfall to these bozos is that they will (believe me) call you until you're 90. They will call your work (I lied and said I don't work there) they will call your home phone, they will call your cell phone (I changed my number finally). They are relentless. However, they are so incredibly illegal, it's not even funny. Do NOT stress over these guys. You need, need, need to file complaints on them. File with the BBB, your state AG, and especially with the FTC. They are very interested in these guys.

Ah cannr, that's what I love about your posts. They make me laugh. How many times have I told you that? Thanks for jumping in and clarifying just who these yahoos are. I couldn't find much on them so I wasn't sure who was who. I tend to be a tad bit of a troublemaker and I don't like waiting. That is why I just went after all my PDLs and didn't give them a chance to make me wait. In the end it paid off for me and I don't even give them a second thought any longer, except for when I come on the board (which is pretty frequently now that school is out) and I see just how miserable they are making people. . . .still. On a side note, if there is no paperwork, then I guess that would explain just how sloppy they are and why they can't find anything to connect them up to anything or anybody. Why can't they just go away!

I would send a letter stating that they are illegal, including the laws for New York State just so they know and that, morally, you are not obligated to repay anything more than you borrowed. Let them itemize what they feel you owe them and how the figure came about. Here's the state law if you need it.

You can copy it over into your letter. Hopefully they will come back with a PIF. Meantime, I would seriously try and find out what was deposited into your account and how much they debited on that same amount. It may take your bank some time to locate it, but I am sure they can get it for you. You might want to speak with the ACH department at your bank. I am assuming you will email as that is the quickest way to get it to them. You can hard copy it if and when you have a physical address. Keep us posted.

I would also follow through. Contact the attorney general, explain the situation, explaint that they are refusing to provide documentation. Either way, don't agree to send any kind of payment, and don't say anything that can be considered an acknowledgement of the debt.
I am certainly not the most knowledgeable person here, but I"m sure someone who knows a little more about this place or your state laws will provide better suggestions and info. :)

Thanks Jen. I am in New York State and I think that it really worked to my advantage when getting these slugs out of my life. You have given some good advice to Sommer. I feel that you can NEVER cover your bases too much when dealing with this situation. I find amazing is that 3 years have gone by and suddenly they "discover" that someone owes them money! Trust me, if someone owed me money, I sure as heck wouldn't be waiting 3 years to try and collect it! Personally, I would ask the bank right now to try and find out what they deposited and what I paid back. I would trust my bank's records way more than I would trust the accounting of a PDL. To me that is the very basis of this squabble and it needs to be identifying ASAP. Just make sure that who ever is trying to collect on this alleged debt does not have access to any bank information that allow them to tap into your funds.

After speaking thru "THREE" rude and demanding people once again that wasn't given to me.I am disappointed in this illegal COMPANY, the service was inadequate. It has been brought to my attention that your company is not licensed to lend in my state, therefore it makes the contract I had with you null and void
