Had a quick question for you. I was reading your thread about dealing with unlicensed lenders and noticed you said you can get a refund if you paid over the principal. I was wondering if you can only request the refund if you are still making payments or can you request one if you paid it off already? I paid off a Speedy Cash loan last week and just found out they are illegal (I'm in IL). Can i send them the letter you posted and request a refund still? Thanks


You can request it at any time. I doubt you'll ever see the money, but you can request it. Send a nice letter to them (sarcastic tone there) demanding a refund of all intrest and fees paid based on the fact they were operating illegally in the state of IL. When they laugh at you (most likely) inform them that you are now filing complaints with the IL AG for operating illegally in the State, and with the FTC/BBB for not following state regulations. Then for fun, figure out what you paid them over what the state of IL allows a PDL to charge, and anything else you can legally tack onto it under IL law and file a small claims court case. If it goes through and you win...when they don't pay sell the debt to a collection agency and have them harass the company for a change.
