I just got a call from some guy with a heavy thick indian accent. He claims that I have an unpaid pay day loan and that they are serving me with papers for a court date. They are out of California, I live in Connecticut. I had a loan about 7 years ago and swear I paid it. I don't have any paperwork anymore it's been so long, and they won't send me anything or give me their address. What do I do? Can they sue me for real?




As the collection agency is not ready to give their address to you, it means they are a scam company. Thus, there are less chances that they will file a lawsuit against you. You should immediately ask them to validate your debt. If you have paid off the debt, then your original creditor won't send it to collections and thus the collection agency won't be able to validate your debt. If they can't validate the debt, you won't be liable to pay off the debt.

Just a side note: Asking a collection agency over the phone to validate the debt really isn't the proper procedure, if you'll read my thread at the link I posted above it will help you handle collection calls properly.

i just noticed that.besides nobody,and i mean nobody will or is required to validate a debt over the phone.almost the same principle as not admiting to or paying a debt to a voice on the phone.
