Update on my Loans (Thank You)
Date: Thu, 03/14/2013 - 16:47
White Hills Cash - Loan $200 Paid - $794
Blue Star - Loan - $200 Paid - $ 712
PayDay Mobility Loan - $200 Paid - 507.50
Dear White Hills Cash
It has come to my attention that payday loans are prohibited in my state. Therefore, the loan contract that I have with you, according to my state's laws, is not enforceable. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. To date, I received a deposit of $200 on 11/15/12 and $100 on 2/1/13 for a total of $385, and have had 8 bi-weekly withdrawals of between $85.50 and $116.50 debited from my account. The total that has been paid is $764. This results in an overpayment of $379.
At this time I am requesting a return email acknowledging that my loan has been paid in full. Also, I would like a refund of the $379 overpayment. A refund check of $379 should be mailed to me at the address you have on file.
At this time I am revoking ACH authorization. You are no longer authorized to withdraw payments from my checking account. I am also revoking any wage assignment I may have signed. I have given a copy of these revocations to both my bank and my employer. Any future attempts to collect funds in this manner will be blocked. Please respond to this email with acknowledgment that my account has been satisfied in full. Details of when I can expect the refund check, as discussed above, should also be included in the email.
Sincerly,
Timothy DeWitt
And here is their initial response,

White Hills Cash relied upon your representations in good faith and approved your loan based upon such representations. White Hills Cash always strives for excellent customer service and we are willing to work with you to achieve resolution of your concerns.
You have revoked our right to ACH your account, as is your right to do so, and at this time we will immediately cease all withdrawals. The remaining balance owed is $305.50 and our mailing address is 5781 West Sunrise Blvd, Plantation, FL 33313.

Third Update
Well I got the paid in full letter from Blue Star which was awesome and I haven't heard anything at all from PayDay Mobility which is weird but I will deal with it. White Hills Cash is definitely been the worse. I just got another phone call today. I have gotten a few but never answered them since the last woman. The girl who called couldn't handle me obviously and put a supervisor on the phone. I proceeded to let her know that I knew their game and I wasn't playing it which she proceeded to tell me I was being reported to Check Data Systems which I then asked " Didn't the woman three weeks ago already do that?" She had no response. I told her that I was going to report her and her company to the AG and FTC. She promptly got off the phone.
actually
i agree with nelly about the letter now respond this way.
since you are tribal the contract isn't worth spit.therefore i am owed 594.00 by you,and i will not give you another penny.the fact that you think i owe is an insult to my intelligence.
respond that way as you are owed as nelly stated.don't believe the lies they spew.
Another Update
Ok so we are about a week into this ordeal and here is where I am sitting. I haven't heard from Payday Mobility at all except an email regarding my next pay day even though they didn't get anything this past Friday so I just sent them another letter. Blue Star actually sent me a PIF letter which was pretty awesome I have to say. White Hills is the most problem with a few emails back and forth with them saying I still owed 300 or so and that they were a sovereign entity who is tribal, therefore not subject to state regulations. It was just email until today when I got a phone call. The woman clearly was not ready for someone who had spent years in call centers. At the end of it she told me that they were sending me to collections and then hung up on me. During the call I told her she would be better off scamming new customers for money because they would never get a cent from me again. She laughed. So 1 in 3 down, 2 to go.
Keep up the good work. Print
Keep up the good work. Print that PIF and keep in a safe place in case needed for future reference.

You may visit this page to know the steps of dealing with illegal lenders: http://www.debtconsolidationcare.com/paydayloan/illegal-pdl-dealings.html
You have taken the right step
You have taken the right step. You have paid more than the principal amount to all the lenders. So, there is no question of making further payments to the lenders. This is a typical letter that an illegal payday loan company sends to the borrowers. So, I am neither surprised nor shocked. I am quite sure that other lenders will send you similar kinds of letters.
