I am having issues with an online PDL called Urgent Cash Advance. They are licensed in Wisconsin, I checked. The collections guy pushed me into a payment arrangement which I just could not follow through on. I was agreeing to $135 by last Friday and the balance of $315 by 7/30. I just can't do it. I had to pay my rent. So, I sent them a letter, certified, with a $15 money order. He got it and e-mailed today saying:

I just received your letter. The letter you have submitted is in direct contradiction to this e-mail for payment in full by July 30th and our previous payment agreement. It is my understanding, based on dealing with credit card debt a few years back, that in order to sue you the debt must be sent to an attorney in your own state in order to collect. And they must first mail you a letter giving you 30 days to dispute the debt before they can serve you - correct?

Are they just trying to scare me? I need some advice on how to deal with them since they are licensed. Any help would be great - thanks!

They are trying to scare you. They will have to file with the small claims court in your state to collect from you and then they have to show up. How much have you paid them and how much did you borrow? Arwe they sending back the 15.00? If they cash it they are back to square one. Where are they located?

Are they licensed to collect in Wisconsin? This sounds like a complete empty threat of legal action. Are what they say you owe legal with your state? Also, you can easily delay this communication by sending them a Letter of Validation, which requires them to disclose how they came to the amount and all of their license numbers. It will slow them down. If in the end, you legally owe what they say, and they are licensed to collect in Wisconsin, then tell them; "The only way they will see a dime, is to work with what you can afford." If they were to take legal action, the judge would only render a judgement that you owe, and it is back to giving what you can afford,. So, either way, they must wait for the full amount.

They are located in Greensboro, NC. I borrowed $300, the fee was $60. They are asking for $450 - almost an extra $90! I sent them $15, not sure what they are doing with it. I will have to check and see if they cash it within the week. I think I will send that letter of validation. Is there a sample one on the forum?

I know, WI laws are awful for PDL's. How do you find out if they are licensed to collect in your state? I thought if they are licensed to lend then they can collect.
