A copy of your electronically signed contract can be faxed for your review. If, after your review, you find your account was handled differently than was/and is stated in the agreement please forward those details at once so further review of your account can be completed. It is our earnest endeavor to provide the best possible customer service and customer satisfaction and miss-handled accounts will be researched and addressed immediately. Any Legal questions will not be answered; they must be placed in writing to our Legal Dept via Fax1-800-470-6614.
Please also note, we are the original creditor, the fdcpa applies only to 3rd party collectors.

[size=1]Regardless of the origin of the context of my letter, whether it be from the internet, a consumer reporting agency or Florida's Financial Regulations Department, the matter still stands. USFastCash IS NOT LICENSED IN THE STATE OF FLORIDA. As per Florida's Attorney General, USFastCash is also in violation of Florida statutes pertaining to pay day loans in this state.
My specific "concern" is that you are an illegal online lending organization, without licensure in the state of Florida. Therefore, you are breaking the law by continuing to loan money to consumers in this state, including myself. Additionally, your interest rates, fees and other wide and sundry charges are in excess of Florida statues pertaining to interest rate caps and usury laws. So, there you have your reason for "my persistence in this matter."
Please be assured that I do not have ANY legal questions. They have all been answered by my State Attorney's Office and, my complaint is being investigated. This is not a "cut and paste" statement but a statement of actuality and fact. I filed a complaint, have spoken to their office on numerous occasions and know exactly where I stand legally.
My bank will not honor any future debits and have been advised of the situation. I have rescinded your right to contact my employer, friends, family or references and I have also withdrawn any wage assignment that I may have signed pertaining this loan. However, if you feel the need to not comply with any of the above, please be advised that all phone calls will be recorded, all wage assignments will be denied (my payroll department has also been advised,) and any attempts at the above mentioned actions will only serve as additional documentation against USFast Cash.
As for any contract I may have "signed" over the internet, by all means please be so kind as to MAIL IT VIA U.S. POSTAL SERVICE to the address I provided: XXXXX. Any legitimate organization's legal department, online or otherwise, would not find this request unreasonable and would also be capable of receiving certified correspondence at their mailing address. So, once again, please be so kind as to mail a copy of my contract. It will serve as additional evidence and, as per the Attorney Generals Office's request, will be immediately forwarded to them to aid in their investigation.
It you would also be most helpful if you would provide me with your audit number for the State of Florida. This request is also reasonable and within my rights as a consumer.[/size][/quote]

I loved it and you should stick it to them. You have the law on your side and they don't. You've done the right thing by filing complaints against them and keeping in contact with your AG. I know the Florida AG does a great job when it comes to this stuff. It will be interesting to see if they respond to you. They usually duck and hide when the tough get going. Watch out because they also lie to government agencies. :x

That's when I began to suspect something wasn't right. So, I closed my bank account, contacted the AG and received the email from them you just read. At worst, they can accuse me of being in default and send me to collections. At which time, I will make my last payment. However, after being on this forum, I've also learned how to deal with the collection agencies these sharks use!

They sent me to their "inside" collections department. They just sent me a bunch of e-mails stating to pay through their website. I never send them a red cent because US Fast Cash owes me money. Then a few months later, they sent me to outside collection agency based out of Texas. I was not schocked when they didn't validate my debt. I never heard from them again. They have been quiet for a long time but they love to crawl out of the rock they live under. collection agencies don't have to be licensed in my state. They just have to follow the fdcpa. Okay, count me as one of the MANY who has received this SAME EXACT letter from US Fast Cash. When I read it, I just though "you can kiss my ass". Now that I've read your response to them, I'm fired up! You're response was over the top! You go! I'm now going to fire off another response to them. As you've all stated, they do not respond. However, as long as we have documentation, that's what will count. So I'm emailing them AGAIN only a bit more bitchy than my last response. MTE is famous for lying. They will lie to the BBB, the AG, everyone and state that they are not this certain pdl. Seeing as how I have 3 pdl's that are MTE related - I discovered this by comparing each response I've received from them. They are all the same exact responses - word for word. So...they're not MTE? The more they ignore our requests, or refuse to accept certified mail, the more evidence we will have against them. kev, US Fast Cash is MTE Financial - the devil. First of all, I can almost be totally positive they are not licensed to do business in your state, as MTE isn't licensed anywhere as far as I know. Did you check to see if they are licensed in the state of Vermont? Also, do you know your state law regarding pay day loans? I'm so sure you've overpaid these people, and more than likely they charged you rollover/extension fees. We need to know Vermont law to see what is legal and what is not. However, if they are not licensed to do business with residents in your state (and I am almost so positive they are not) they are doing business illegally. This is the "norm" for MTE Financial. US Fast Cash is one that I am fighting tooth and nail right now.

Make sure your bank won't clear items after an account is closed because some do and then you will owe the bank lots of $$$$ that is very hard to get them to reverse. Good luck!

It is hard to get my bank to stop it, so, I withdrew all my money, let items bounce and will wait until they close it for me. Then, I am going to deal with the bank. Meanwhile, my check now goes to a NEW bank.

kev, have you tried to close your bank account? All banks vary regarding closing an account. If you can't actually CLOSE the account, you can put a hard debit block on it so that NO debits can hit. You need to do this ASAP though. You can try to play "the game" and go suck out all your money before the pdl's hit, but if your account is open, the pdl debits will hit and cause you to go into the negative and then the bank will charge you fees. Ugly, ugly to get resolved. If at all possible, try to get that account closed. If they can not promise you that any debits coming through won't "force" the account back open, then tell them to put the hard debit block on it. Go to a different bank and open a new account.

But then again I would hate to see all those pdl's hit and cause him to be in the negative and then have fees added on. You know the feeling! It's really up to however he feels like handling it. It's different for everyone. But, from your experience, you know that the pld charges going through cause havoc on your account if you've taken the money out! Ugly!
