Hi-- I'm a little confused. Wamu/Chase closed my checking account. Activity on the account has been restricted since 5/4, and the account was scheduled for final closure today. So no checks or ACH have been honored since 5/4. Meanwhile, I have 5 payday loans, all of which were scheduled for payments on friday 5/1. Payments for two of the loans went through on 5/1, but for some reason I guess the payments to the other 3 didn't "clear" on 5/1. Normally, they would just have posted on 5/4. But because my account had been restricted, they didn't go through. I received emails from all three informing of the returned payments and telling me to call them, which I didn't. However, I only received the one email and I have received no phone calls either at home or at work. The three companies are usfastcash, united cash loans, and ezpaydaycash. I live in NY where payday loans are illegal, and I guess from what I have read on this site that usfastcash and united cash loans are illegal everywhere.

Now that my account is officially closed, I was going to send my letters out tomorrow as people on this site advised me to do as well as provide copies to Wamu/Chase in case they might reopen my account if there were a lot of attempts by pdls to make debits. However, I have not heard from any of these three companies. Tonight I steeled myself and went online to look at my accounts. Usfastcash and united cash loans have my accounts listed in collections. From the looks of it, they both tried to debit my account again on 5/6 but seem to have made no attempts since. They have my balance down as o.oo and have no "next payment date" listed. EZpaydaycash seems to have no information about my loan in my online account. I can still sign in, but instead of getting info about the loan I already have, I am just taken to a loan application page. I do not understand why they are not hounding me. I have bounced payments to all three at least once in the past, and they have always hounded me until they were able to debit my account or I contacted them. Does this mean they are just going to sic a collections company on me? I am wondering whether they received some information from the bank indicating that my bank was closed and that the closing was the bank's idea, not mine.

Also should I still send out the letters, even though they are not hounding me? I assume so, but I am wondering how much I should offer to pay if they aren't actively going after me yet to get the money? . . . .

Thanks-- I am just so perplexed not to have the phone ringing off the hook, though I guess this is the lull before the storm--

Callie

I would go ahead and send the letters. That way they will know that you are disputing any claims they may want to do. It will also revoke their ability to access your wages and call family, friends and employers. They may just be waiting to see if your account opens back up. Be proactive and send the letters anyway. It can't hurt you and can only help if they know that you know that they are illegal.
