I had a collection agency call me saying that I was going to be sued for attempted fraud for non payment of a payday loan. I asked for them to send me something in writing to validate the loan and they said the only validation they would give is a court summons. Is that legal? Will they really take me to court?

That is not legal. You can send them a debt validation letter and ask them to formally validate the debt. Unless they validate the debt, you're not liable for paying them. Even if they take you to court, you will win the case if they are unable to validate the debt.
