i think i am going to be sued??

i received a phone call today from a mr shapiro today about a loan that i took out back in 2006 for 300.00 of which i had paid 355.00 now they want to sue me. and then he claimed that there was some type of investigation being done on me that i was engaging in fraudulent activiteis and that i would have to appear in court on May 28 before the judge and that if i lost i would have to pay in excess of 2000.00 so i listed to what he said i did not argue with him but i will be talking to an attourney tomorrow in the mean time i did file a complaint with the federal trade commition. i went to the website for bbb and supposedly this srs company has a B rating. but now that i look bak on this i remember sending out an email to all my creditors stating that i was having money problems and that i was closing my checking account. the rep from VC LENDING called me and was asking my what happend and i was told that since i was a good customer that my loan would be forgive (s/h gotten that in writing) now 3 years later they want to sue me??? can anyone give me some feedback on this???

If you didn't get the statement in writing that the loan was forgiven, or even a promise in writing, then they are free to sue you as long as the statute of limitations has not run. You should talk to your lawyer about your state's statute of limitations for this kind of debt.
Not paying your debts is not fraud, that statement seems to be going around lately in order to scare people. My advice is that if you have chosen a good lawyer, you should ask him/her any questions you have and not take the risk on too much advice from someone who isn't licensed to give legal advice in your state.

a total of 355.00 i have saved my old statement from the checking account before i closed it but i am going to call my c/u in the moring to get a fresh copy as i no long have that checkinc account. so whether or not they forgave it the loan was pretty much paid off. and now i have the back up to prove it.

Can you tell me who your payday loan was through? I'm betting they're illegal lenders, in all states. If that's the case, you've already overpaid them by $55 because you're only required to pay the principal back ($300). The fraud stuff is BS anyway. They're trying to scare you. We can give you step by step instructions on how to move forward. And, you may even be able to get your $55 overpayment back ;)

the loan was through vc lending i am having my credit union check my old account records and she will fax over to me the copies i have are all marked up so i can look at a clean copy and tell exactly what happen. in any event i have already filed a complaint with the fed trade commi today i am going to file complaints with mass state ag as well as the state ag where the company is located.
