Greetings,
I have been reading this forum on payday loans for days now and have accumulated great information from you all. I have two pdls thru Sonicpayday.com/Northway Financial/E-Care. I will provide all information so that I don't waste your time.
State: Virginia
PDLs are legal but I did not see this company as being licensed in VA. They are strictly an internet loaner.
I called a consolidation company yesterday and they offered to help me for 30% of my debt, which is over $1K! I had a pdl that was due to be paid on 6/10/11. My account was compromised by someone I know - in fact this whole nightmare began because boyfriend found out about me using pdls to meet our bills. He wasn't having it and took out $ from the acct the morning of 6/10, which caused my loan to not be paid. Since I have a good history with the company, they allow me to request a new loan the same day. So, as you all know the game, I applied for another loan on 6/10. I found out Saturday morning that the acct was cleared, in fact I was a negative -135.00 with NSFs.
Knowing that there is a 48 hour cancel policy, I faxed notice to cancel the loan immediately. Sonic wrote back an email and said that the $ of $1400 was already issued. No problem, I deposited enough money to get a positive balance and if the $ deposited, they could just debit it out. Not what happened. Monday morning I checked and sonic had deposited the $1400 and it had already been taken out by now my ex. I immediately went into the branch and closed the account. Then I opened up another account at a different bank. Regardless of what happened, I know the money has to be paid back. I am not in a good place right now and although I explained the situation to e-care who is the first company to enforce, they just want the money. I now owe them around $3,000.
These people are ruthless. I have asked that they stop calling my work, but they still do. I am writting letters tonight to send to them. Has anybody had a good response with this company. Although I'm giving this problem to spirit, I know that I must use my free will to make it right. Appreciate any advice and I apologize if it is repeated information.

I will suggest you to immediately contact the Virginia Bureau of Financial Institutions in order to find out whether or not your payday lenders are licensed to operate in your state. If not, then you will be liable for paying them only the principal balance. However, if your payday lenders are licensed to operate in your state, then you will be liable for paying the whole amount. In such a situation, you should go for payday loan consolidation in order to get rid of the debts.

As far as I can tell, Sonic is not a licensed payday lender in VA.

Contact the VA department of finance, as Anna stated. File a complaint there, with the VA Atttorney General and with the FTC. Also, I would file a complaint on the Sonic website.

Send them an email using the template found in the sticky entitled "dealing with unlicensed payday lenders" (found at the top of this forum).

You should only have to repay the principal balance of the loan.
