[LEFT]Hey all. I've got several payday loans that I need to get taken care but financially my hands are tied until next month. In the meantime, Tremont Financial has sent me a letter stating that if I don't make a payment by the 17th they'll send a wage garnishment letter to my employer. I want to know if I can revoke it. I didn't sign it in person, it was done via scan/email and this wasn't on its own page, it was the this little section below that included at the bottom a Military Identification statement.

CONSENT TO ASSIGN WAGES UPON DEFAULT


By completing and signing this Agreement, should you as Borrower default on repayment of the Note, you authorize Tremont Financial, LLC (“Lender”) to contact your current employer or future employer and hereby authorize and request your employer to pay Lender directly any remaining amount owed by you to Lender on this loan. Upon presentation of this Consent to Wage Assignment, you request and give your employer your consent and specific permission to pay Lender the remaining balance due on your account directly from any employment wages owed to you, in installments of up to 20% of your gross wages each pay period until your account is paid in full. You hereby release and discharge your employer from any and all liability whatsoever to you by their fulfillment of this Agreement. You declare that you are over eighteen years of age and that you are not in debt to your employer. Lender agrees that this Assignment of Wages clause will not be executed unless Borrower: 1) Is in default of Note; 2) Remains in default for more than 14 days from the date that payment is due; and 3) Is sent written notice by Lender of intent to exercise this Wage Assignment Clause.

Yes, you can revoke it, doesn't matter if you signed in person or not, wage assignments are revocable at any time, just make sure you show a copy of the revocation letter to your employer because lenders such as Tremont will attempt to send it through anyway. Also, keep one thing in mind, they can't garnish your wages without a court order, they can only use a wage assignment, but since you are going to revoke it let them threaten all they want, not a thing they can do after you revoke it.

now in additon to the wage assignment revocation letter,get out a DV letter as well.send both together,certifed mail return receipt,but give a copy of the wage assignment letter to your payroll,or HR person before sending it.
