Received collection call at work threatening to garnish wages
Date: Wed, 06/17/2009 - 10:26
Hi,
We had 4 payday loans, closed our accounts, sent cease and desist letters, etc back in April. Well, today at work my husband gets a call from a company named LRA 866-520-1240 and stated they were hired by National Payday Loan Company to collect on this debt. They stated if we didn't make payment arrangements that they would contact his payroll department to garnishi his wages. My husband couldn't talk at work so he had me call them back.
I told them that internet payday loan companies were illegal in Indiana and that I sent a C & D letter that any contact will be made through mail or email. He stated he wouldn't contact him at work again, but he will be notifying his payroll department. I told the guy that we have retained an attorney (for something else) and gave him his name and number. The guy stated they were NOT illegal and I should have my attorney call him. I said he can contact our attorney if he has any questions. He asked if I wanted to make payment arrangements on the account and I said NO, he can contact our attorney. He said again he is going to contact my husbands payroll department.
What do you think about this. Can they call his payroll department? Can they garnish wages? If they do call, my husband could lose his job. He is in upper management and said the company won't put up with stuff like this. Now we are really worried.
Any thoughts or advise?

Mail and fax a revocation to voluntary wage assignment.....give a copy to his payroll department too. They cannot garnish without taking him to court first but he probably signed a voluntary wage assignment form.
