I have several pay day loans out. closed my checking account and debit card because they were taking money out and I could not live. I have made some type of arrangment to pay off. I am using a prepaid debit card to pay some of the lenders and using money orders but try to get them to accept what I can afford is one thing. There is one lender that is threating to garnish my wages I have made a small payment on the loan. I am waiting to get the actual prepaid debit card so I can reload the card with money. I have a temporary one, so the lender is threating to garnish my wages if I don't make a payment of $30 dollars I offered $10 because that is all I have on the card until I get the actual card besides I am broke until I get paid. I get paid every week. The temp card won't let me reload. This lender name is Flobridge. Can they garnish my wages even if I am make all effort to pay? This has been a nightmare.

Making an effort to pay is not the same as actually paying. A loan is a contract, and in any state, breach of contract is a strict liability civil offense. Meaning if you don't comply with the terms, you're in breach and if you continue in breach of contract for the term spelled out in the contract/state law, then your creditor/collection agency can sue for the money, and if your state allows garnishment, then they can get a judgment that will allow them to start garnishing your wages.

if it's internt then they can't garnish period.they have to take you to court first.what the losers are refering to is a wage assignment.those are sheets that some pdl's have you e-sign that states they can take from your wages if you default.wage assignments are voluntary, and revocable.draft a WAGE ASSIGNMENT REVOCATION letter, and give it to your HR or payroll person.then the ipdl can do nothing.flobridge is bottomfeeding pdl that isn't licensed.get the letter to your HR person then watch flobridge squirm.because they can't do squat.except to stupidly threaten.

right, but illegal ipdl's will submit a wage assignment.some HR will honor wage assignments unless they are revoked by the person.important to cover your bases.
