Zip19 -- Need help/advise
Date: Sun, 10/14/2012 - 20:09
My husband has taken out several loans with Zip19. They are as follows
8/20/12 -- borrowed $400 -- repaid $479.92
9/4/12 -- Borrowed $550 -- repaid $659.90
9/17/12 -- Borrowed $800 --repaid $959.84
10/2/12 -- Borrowed $1125 -- repayment will not clear the bank. Its over $1300
We live in New Hampshire and he works in Massachusetts.
After doing some serious research this weekend I've discovered a few things.
1. Zip19 is illegal in my state(not to mention the country)
2. In August 2011, the NH finance commission and the Attorney General issued a cease and desist against Zip19(and all its entities) barring them from doing any business within the state of NH
3. According to the Massachusetts law guide that I found online, they can not use a wage assignment, even if signed by him, without my approval.
I have already taken steps to keep them out of my bank. I have opened a new unlinked account and am closing the one the ach comes out of tomorrow. He plans on sending the wage assignment revocation letter to payroll/hr tomorrow(even though I dont think we will need that according to law?
My assumtion is that Zip19(northway) will not be aware of the funds not clearing until Tuesday. So my questions are as follows
1. Should he send they email to them prior to them finding out that the funds didnt clear or should we wait for them to contact us regarding repayment??
2. I believe we are only responsible for the principle for the $1125 loan and not all of it due to the overage paid on the other loans. We are willing to pay the principle, on our terms of course. Would I have better results if I offered to pay the full $1125 principle or if I try to strongarm them into the lesser amount??
3. Should I include a copy of the c&d issued by my state in 2011 or should I just mention it??
4. Would it be beneficial to make them aware of the Massachusetts law regarding wage assignments??
I feel like the more information I provide, the better results we will get but having not dealt with this in the past, I truly dont know that that will be the case. I almost feel(hope) that if I pretty much put it to them that "this is the only way you will ever see another penny from us" then maybe we will be successful.
5. Can someone give me the very best email address to send this to?? Should I send it to more than one??
6. In others experiences, how long did it take to get a response from them?? I'd like this settled asap(wouldn't we all).
Wow...I've rambled!! Please help!!!
MA law does not apply...you are governed by the law of the state
MA law does not apply...you are governed by the law of the state you reside, not work in.

Since NH finance commission and the Attorney General issued a cease and desist against Zip19, the loan itself is null and void. Legally you owe nothing, but you should pay back the principal. However since the previous loans were all illegal and subtracting the interest you paid, you only owe about $775.
You do not need to tell them the laws....they are well aware of them. Tell them you will pay the amount due by money and mail only....no need to go to any expense in doing prepaid debit card or western union...mail only.
Get your ACH revocation done immediately and get a copy to your bank. Plus the voluntary wage assignment revocation...your employer needs that too.
thank you
Thank you for the speedy response.
So if I am to go by the laws of the state that we live in, and not work, NH does not recognize wage assignments. I was going off of the Mass laws because he works there. I will still do the letter but I am hopeful that it wont even be necessary due to the guidelines in both states.
I had calculated about the same as you on what he owes. I'd prefer to pay them nothing, but he did borrow the money so if we are stuck paying the $1125 back then so be it.
How effective will this be?? Will one email to them do it, or is this going to be process?
Email it asap....then mail a copy. Believe Zip is in Malta.

no response
i decided to get myself out of the payday loan cycle at the begining of october and sent my emails on october 2, one of them being to zip19. i have not yet heard from them wheres the other ones i heard from within a week.
Wage assignments that aren't signed in person and on a separate
Wage assignments that aren't signed in person and on a separate piece of paper aside from the loan agreement are null and void anyway. Zip19 knows that too. Zip19 is an illegal loan company here in the US that are based out of Malta which someone already said above me. We had a loan with them before and then I found this site, researched everything I could and emailed them the revocation email and what they owed us. I tried to log on to the website and it says account not there. So they got the hint real fast.
A smallish update
I'm going to take this as a good sign.
Sent the revocation email last night. Was probably too detailed as I did mention that the State of NH had issued a cease and desist to them last year that they have clearly not followed. I also mentioned the fact that they could try all they wanted to assign wages but it would be denied as my employer has already been informed of their fraudulent activities and have assured me that any attempt at contact would be declined and would be reported. Also threw in that it would need a court order and approval of my wife(me as I am taking care of this for the hubby) and they could rest assured that they would get neither)
Woke up this morning and after seeing Hiya's response I decided to try to log into the account. DENIED. We have been denied access. Which tells me that they did in fact receive the email.
So I guess now I wait?? No phone calls as of yet to the house or cell or work that we know of.
I had asked for a response within 48 hours but I am assuming I wont get one at which time I will resend with the clause that if it is not responded to, I will consider the account settled and any previous offer to repay principle will be rescinded.
I am soooo happy to have found this board. This has been making me sick to my stomach and I have calmed down considerably since reading on here and seeing that good things can actually come of this.
