first, take a deep breath, second, get all your documentation regarding payments together and draft a letter to your states attorney general & BBB. If you have overpaid, (which it clearly sounds as tho you have) then demand your account be settled. Once they get contact from the AG & BBB they will offer to settle. Dont stress to much if you have overpaid they dont have a leg to stand on.

Since Westbury is the original lender and not a third party collector they are not under the fdcpa rules. You can send them a C and D letter because your state probably has a law regarding that. You can also send them a letter stating the laws of your state and demanding a paid in full if you have over paid according to your states laws. The are a very difficult group to deal with. Stand your ground. File the complaints as Paul suggested and tell them in your letter, sent certified return receipt, that you intend to do so.

A debt validation letter is for them to prove the debt is valid and the have the legal right to collect it. That is part of the Fair Debt Collection Practices Act and only applys to third party collectors. I would not call them!

I did a little reasearch on Westbury Ventures and they are a Payday lender with several companies under one umberella. There is even a case Clark v Westbury Ventures where they were sued in Illinois under the fdcpa even though they are a lender. Unfortunately it is a locked file and I could not find out any more. Because they are reloaning borrowed money some courts may see them as a third party collector.

If you have trouble with Westbury, you can try reporting them to the BBB. They have an unsatisfactory record, but they address almost all their complaints. When I complained, I filed it with the BBB of Delaware. Westbury contacted me within 1 day and sent me a PIF. They were awfully NICE about it, too.
What happened?
Sp Buffgirl03 what happened with the lender? I have received a call from them stating that I need to give them the name of the lawyer I would be using in court. I asked what for and the rep said I was going to be sued by their office for internet fraud because my checking account has a hold on it. I want to pay my bill but I will not pay fees I do not owe and they should provide an option to pay not go directly to court.
