Hello,

I recently took a pay day loan ( I know bad idea ). All is fine with the loan I have out the problem is I received a call from The Loan Shop. The lady started out by saying you took out a loan with our sister company and they sent your information to us and you are now at this bank (they had the correct bank name). I had no idea what she was talking about so I first said yes. She said well you owe us $574 for a $300 loan that you took out in October of 2008. I told her I didnt know what she was referring to and to please send me the info on this loan. She said no you need to make a payment arrangement right now and we need $50 to hold the loan or we will debit the full amount from your bank. I told her I never gave her my bank info and she said yes we have it. So then she called my work and started emailing me. The emails were strange because they would come from different people at the Loan Shop but signed by her. The subject said we have received your new banking information and in the emails she says we are giving you the chance to contact us ASAP to set up arrangements or we will debit the full amount. I did write back and told her that I must have proof that this is my debt before I make any payment and that they do NOT have authorization to deduct any money from my current account, and they are not to call me at work. So it went on and on.. they would just say they have all the evidence needed in my contract to deduct from my account and that I was officially noted that on Oct. 23 they will recover the funds. After emailing back and forth they sent me an authorization to sign and have my financial information released to me and that it will not matter if I send it back in the 24 hours or not because they will recover funds on the 23rd.

My question, I did have some payday loans a good year to a few years back, I ran into a problem with the one because they were debiting my account early and then would not stop.. it ran my account up to $700 negative because everything was bouncing due to this. They wouldnt make an arrangement and would not stop. I closed the account and never heard from them since. I do not know what company that was...it was an online lender and I applied to something and they just deposited it, it was shady to start.

If this is the same company can they really come back a year or so later and somehow have gotten their hands on my new bank info and legally withdrawl money from my new bank account?? I would pay it back if it was really mine but the entire thing is so shady. I am afraid to sign this authorization form to release my contract as I think I might be fueling the fire or giving them permission to do something??

Can anyone give me any advice on what to do?? I did go to the bank with the emails and they did close my account for me.. I am hoping if they try to debit money tomorrow that it will not re-open my account and cause all kinds of fees. How do you handle these people??
