Western Sky Loan turned over to Delbert

If you have a Western Sky originated loan that was turned over to Delbert Services and you received correspondence or a phone call from them threatening a lawsuit against you for these illegal internet loans, can you please let me know ASAP?


Surprisingly, I haven't heard a peep from them once I revoked ACH and sent a C&D, other than the letters they CC'd to me when replying to the Louisiana OFI.

I haven't heard anything back from my OFI. The last communication was just Delbert printing out the exact contract I'd already sent to my OFI and my payment history.

I haven't seen them on my credit reports yet either, but Cash Call closed the trade line so they aren't reporting anymore either.

Should I be worried by all the quietness?

Only received one letter from Delbert Services March 25th, 2013 - no date on letter from them. Faxed C&D to them on 3/27/13 and cent CMRRR same letter they received on 3/29/13 at 2:43 pm -- I have not heard a peep from them since..

JujuNola -- are you telling me that CashCall is not reporting any negative info on you credit reports anymore? Or is it showing as a paid off charge off? If they dropped off your credit report, you are a VERY LUCKY person as everyone I have encountered who is fighting this loan has been dealing with their credit reports being destroyed by their constant negative reporting.

I haven't received anything from them either since the C&D I sent in the beginning to them. But, what I am interested in are those people that have posted recently that they have received phone calls or correspondence threatening them with a lawsuit. Or those people that are being harassed by Delbert to sign a new agreement.

My father has a CC loan (that's how I ended up on this forum) and I negotiated on his behalf all the way up to the head of the collections department to agree to pay the principal back and they agreed to remove it and did as such. Took about 4 months though.

Waffels.....yours is the only success story I have heard of with these people. I'm guessing maybe it is because you caught the Opt Out in time to negotiate or you just have some mad skills one of the two. No one else has that I have encountered over the past year and a half has been able to negotiate any type of settlement no matter what, nor has anyone been able to dispute it off their credit reports, even those of us who have pending lawsuits against them or live in states where they have been can't budge them off credit reports.

Momofthree, I was never late when the loan was being "serviced" by Cash Call so they had no reason to report late. Between the time of my first payment to when they switch over, I was due to only make 2 payments and they were debited. BUT THEN I WISED UP and I guess got lucky. As I was preparing my ACH revocation letter, I get the email from Delbert telling me they're now the servicers. As that point I finally went ahead and revoked. It took about a month for Cash Call to close the tradline, but it's not reporting negatively at all. It says "Transferred; closed/never late", with a creditor's statement that the loan was transferred to another lender. Now that Delbert has taken over I haven't heard a peep unless it was them replying to the Louisiana OFI. I guess it's lost in the shuffle and/or they know they can't report it. I'm not sure, but I'm definitely keeping an eye out. It's been almost 2 months since I revoked ACH and I haven't paid back the principal. I set the terms in my letter statting I would pay prinicpal ONLY but again, Delbert never replied.

I got letters in writing from their compliance department that upon receiving the principal they would delete it from credit report. I originally was arguing for them to report it as paid in full but compromised on deleting it. I think it is because they knew from the beginning they weren't getting anywhere with me. I basically told them flat out we either do it my way or they get nothing, and I made it entirely clear to their staff that I knew very well they couldn't do anything to my father and that for all intents and purposes, I was returning money they gifted to him as a courtesy.
