Hello all, One click is the only company so far that won't accept my payments on my terms. This is what they said to BBB. I have overpaid them and I only wanted to pay back the balance owed towards the $350 that I borrowed. I already paid them $190 in fees....but they want me to pay the full amount of $350 back. One of the PDLs that I deal with closed my account with PIF, two others gave me agreements on my terms and the last two I have not heard from. Why is One click being so difficult. I even emailed them and said I will pay the $350 but I can not pay it by 11/9....I asked if I can pay it in two payments one on 11/16 and the other on 12/14. They declined that. I can't pay them by 11/9.

RE: Case #

Ms :
We stand by our previous reply. This customer was a repeat customer and well aware of the terms and conditions when she accepted our funds in her account. We are under no obligation to reduce her account, and waive any fees, yet we have offered that to this customer, despite no errors on our part in regards to her account.
We do not believe asking for the funds we placed in her account to be unreasonable.
Her account will go back to full collections on 11/09 if the reduced balance is not met.

Thank you for your time and consideration in this matter.

Respectfully,

Compliance Department

Have you filed complaints with your state ag and DFI? I got those e-mails from one click also, but I also had a previous loan from them also. I wrote e-mail after e-mail then I got kind of nasty then I finally got them to reduce the amount I owed due to NSF's caused by them taking from an account they knew was closed. I told them that I would be forwarding everything to my state and if they diddn't want to work with me they can work with my state instead. So they sent me a counter offer that I accepted and withdrew my complaint with the BBB. I can look back and find the e-mails I wrote and PM you the letter. Just let me know if you would like that.

Did you reply to the BBB yet? If not, reply back and say that you do not accept this and why. Are you aware of the pdl laws for your state? If One Click is charging you a higher interest rate that your state allows, or any other part of the loan is not in compliance with your state laws, then you are only obligated to pay back the principal of the loan. If you have already paid $190 in fees, then apply that towards the $350 principal borrowed, so you would only be legally liable to pay them back $160 now.

They are going to talk crap, as they did in the response to the BBB, whether they are in the right or not. I had a pdl, which I overpaid by a few hundred, and the pdl told the BBB they would settle with me if I paid $100 more. No Way.

Have you filed a complaint with your Attorney General's Office yet? You could send a payment of $160 with a letter advising that that since becoming a customer, you found that their loan terms are illegal according to your state laws and they are not a licensed lender (if this is the case) and that you are only legally obligated to pay the principal of the loan and $190 has already been paid, so you are paying the remaining $160. Inform them that you want the account marked as PIF, and that if they are not prepared to do this, you are filing complaints with your state AG office as well as the AG office in their state, and they can follow-up on the matter. Send them a money order and the letter via certified mail/return receipt requested. I guarantee they will at least cash the money order. I have never heard of a pdl who sent money back and wouldn't cash the payment.

Cease & Desist Order Issued to Nebraska Internet Payday Lender

Lincoln, Neb., Aug 29, 2007-- The Nebraska Department of Banking and Finance (NDBF) has issued
an Order to Cease and Desist against SFS, Inc., doing business as One Click Cash, located at 52946
Highway 12, Suite 3, Niobrara, Nebraska, from operating as an Internet delayed deposit services
business. According to Department records, One Click Cash does not have a license to operate a delayed
deposit services business in the state. Delayed deposit services businesses are commonly referred to
payday lenders.

The Department issued the order after investigating 18 complaints made against the company,
including two complaints from Nebraska residents. A number of the complaints were forwarded to the
Department by financial regulators in other states.
All of the complainants allege that the company charges fees in excess of that permitted by law for
delayed deposit transactions and automatically renews transactions on the due date. Renewals continue
for several months resulting in customers paying the company more than double the amount of the original
advance. Customers also allege that One Click Cash electronically deposits the advances into their bank
accounts and repeatedly debits their accounts for fees associated with the transactions. Customers
complained that notices to revoke the automatic withdrawals they sent to One Click Cash were routinely
ignored by the company and that the company continued to debit their bank accounts. Even after the bank
accounts had been closed, customers complained that the company continued to attempt to withdraw
funds from the accounts and attempted to charge fees for failed attempts. Such practices are illegal under
Nebraska law. Further information about the order can found by searching the NDBF Web site at
ndbf.org.

NDBF encourages Nebraskans to report unlicensed Internet payday lenders. More information
about the laws governing payday lenders can be found on the Department????????s Web site. If you have
questions about the order or any investing or banking matter, call the NDBF Consumer Hotline toll free at

I received a response from One Click. They will accept my terms. I am going to pay them $350 in three payments. I am happy with this arrangement. I borrowed $500 from them and I checked my bank statements and only made one payment of $150 so I owe them $350. They were right about that. This is the email I received from them.

"You can have this arrangement, but if any payment is missed the arrangement will be cancelled, and full balance will be reinstated.
You cannot change this arrangement either. The first payment must be made on 11/16, 2nd on 12/20, and the 3rd on 01/03/08."

WooooHooooo way to go Gina :) I am glad to hear that you got the payments on your terms :) And if you get in a bind and cannot make the payment all you have to do is call them and let them know. What I did to pay them is I went to my credit union and bought a visa gift card and gave them that number so they wouldn't have my new account number and they could only get what I put on it. They only cost me $3 instead of using money gram or western union at $15.
