I recently closed my bank account and filed a complaint against AIP with the BBB. If you recall they did not provide me any written agreement, document, contract .....regarding my PDL. They said that a verbal committment was binding....I sent them a letter revoking any and all debit authorizations regarding my bank account and advised them it was closed. I also advised them that it is not legal to enter into a PDL without a written document. Well - today I received a call from a Chris at AIP. My caller id said ECS Inc....anyone heard of them? Anyway - Chris informed me that they were unable to debit my account and were considering charging me with "intent to steal" as well as they were adding additional fees to my balance that had been originally "waived". I was never verbally informed of any waived fees. I am sure this is a scare tactic. What do you think?


Definitely a scare tactic! Defaulting on a payday loan is not a criminal offense. I would also suggest filing a complaint with your state Attorney General's office and then notifying AIP that you have filed another complaint against them, and the AG will be following up with them.

You may find that they back off.....

I appreciate the response. I figured they were using scare tactics. I will definitely file additional complaints. Has anyone else had a loan with AIP with no documents? I can't believe I was so foolish to enter into an agreement over the phone. I asked if they were going to email or fax my documents. when they said it was a verbal agreement I should have known how shady they are.

"Intent to steal"...I don't even think that's a real charge! These pdls kill me with their scare tactics. Next time tell him you are going to counter charge and charge them with "Intentional lying" which is also not a real charge! But at least it's the truth when it comes to them. :-)

I like that "intentional illegality".... That would be fun to say out loud....

But my thoughts on "intent to steal"... That does make no sense. There is no way to prove someone intends to steal, and if you are caught in the act of stealing, then they just charge you with stealing. Not intent to steal.... Dumb, just dumb

candy, I had a loan with AIP. No documents, no nothing. Don't feel stupid. There are MANY of us who did this. You did file with the BBB on them, correct? I got mine resolved through the BBB alone regarding them. However, you still need to file complaints with your state attorney general and the federal trade commission. Especially on these "verbal agreement" loans. And, yes, your phone call from them was a bunch of crap. They don't have a legal leg to stand on. See what their response is from the BBB. You might get it resolved right away. However, don't forget to still file with the other agencies. And they may be using "EDESA" as a name on their phone calls and their debits.

How did they end up resolving yours? How long does it take to hear back from the BBB?

Candy, I am sure Cannr will fill you in on her experience, as for the BBB, I filed on seven companies all at the same time. I have heard about three and only one was resolved. I filed about a month ago...can't exactly remember. Many times they do not respond to the BBB. Two of mine have been contacted twice and have not responded.....the others who knows. Do not get frustrated. Hang in there. Cute avatar!

candy (love the avatar!) when I filed with the BBB, it took about 30 days. This is because the BBB will contact AIP (and AIP is pretty good at responding to the BBB) then AIP has a certain time limit to respond back to the BBB. Sometimes it's 2 weeks, sometimes it's 30 days, it just depends upon which BBB you're dealing with. So give it about 30 days. If you don't hear anything, check back with the BBB and check the status of your complaint. They will let you know if AIP has responded. But, candy, AIP has responded to almost every single person who put in a BBB complaint. If you have overpaid, you will more than likely get a refund (I can't PROMISE that, but it has happened). AIP likes to get it resolved through the BBB so that it doesn't go any further.

Hi there Candy! I also had a "verbal" loan with AIP. As Cannr has mentioned to you, file all your complaints, and AIP will get it resolved. I received a full refund of all the money I overpaid....so, it isn't a hopeless situation. It just takes a little time. Good luck!! Keep us filled in....
