help with pay day loan collectors

Back in 2006 or 2007 I wrote a check to Advance America, in Texas, for a pay day loan and I did not pay them back. A collection agency called me a couple weeks ago and told me I could make payments but I have to send them money THIS month, or risk going to "court". The lady made it sound like all 'ell was going to break loose if I didn't send them money THIS month. I agreed to make payment but I couldn't send them anything this month because I don't have any money.

They told me they would contact me again within 24 hours and they didn't call me back until today. They threatened, again, to take me to court and they hung up on me.

Is the statute of limitations of pay day loans 4 years, or 10 years ? Can they still take me to court ? I want to resolve this but they seem to be trying to instill fear into me.


The immediate problem I see here is that since Advance America is a storefront, this means that they are probally legally licensed to do business in your state. What does that mean? It means that your chances of being served with a summons are pretty high.
Your only chance would be if the SOL on the loan does run out--but I would work on making payment arrangements with them.
You would not get a summons for criminal court, but for civil court.
