Payday Loan Debt! Please Help!

I have recently looked over these forums and I see that there is a lot of information in regards to payday loans, both store and online, and how to deal with them.

I have currently gotten myself into a jam and I am in need of some help.

I have 4 payday loans, all through online websites:

Thinkcash - Borrowed $700, but currently paying back with payments of $109 every two weeks. I have 8 more payments from them, as I am currently past due by one. So last payment due in March, unless I can pay them off earlier. Payback amount is $850.

Check-n-Go - Borrowed $550, but currently paying back $157 every two weeks. Only have one more payment left to come out December 23rd and I plan to close the account. Payback amount was $850.

Cashnetusa - Borrowed $350, currently extending loan and payback amount is now $441 and due the end of January.

Zip19.com - Borrowed $725, payback amount was $830, now past due and payback amount is now $930. Unwilling to work with me with payment arrangements.

Between just those four, as those are the only ones I have, the Zip19.com is the most difficult one and hardest to payback. The other three are very manageable and are easy to payback in a timely fashion, but Zip19 is the major one that I can't seem to fix.

What can I do to get them to work with me? I do not want them contacting my employer at all and I do not want them calling me anymore. With my bank account, I can fix that easily, as my bank is always willing to work with me as I have had them for years, but I want to fix the Zip19.com problem more than anything else.

Any help that I can get would be great!

You need to close your bank account immediately. That is the only way to stop PDL's from accessing your money. Looks to me like all of your lenders are legal accept for Zip19.com. Thinkcash you can pay them bi-weekly with a prepaid money card, as I do that and it works well. Cashnet and Check n Go are both legal lenders and Cashnet is easy to work with so set up a payment plan with them. I don't have any experience with Check n Go. Zip19.com I would send them a Cease and Desist letter, with draw your ACH and any wage assignment, file a complaint with the AG, FTC and BBB in your state. After that I would send a copy of these complaints to zip demanding a PIF letter and refund for the amount paid over and above the principle loan.

In regards to this letter, how long will it take for them to respond to my demands? Should I send it through email or in mail form? I want this to be taken care of immediately so that they do not contact my employer or anyone else in regards to this account. I'll get in touch with my bank as well. The other companies are very easy to work with, but Zip19.com is horrible. I got into a heated argument with them yesterday and I eventually had to leave a message with a "supervisor" in regards to sitting something up. In my message, I requested that they send me information in regards to them being legal in my state and authorized to give me loans in my country. I also told them to not call me during work and only call me during the hours I am at home. But, about an hour later, while I'm at work, they call me on my cell phone (of course I can't answer) and the supposed supervisor just stated "Hello.....? Hm...." and hung up. Not even a message! They haven't called me back since then, though, but I don't want them to do so any time soon.

Zip19.com is not even legal in the State of Ohio that is why they are being difficult to work with. Send the letter via email and mail (certified/return receipt). Since they are not legal in the State of Ohio, they are NOT going to do anything to you. Go to your supervisor and tell her you have been a victim of fraud and if she should receive any phone calls to simply hang up and ignore them. Send them the letter, you may or may not ever hear from them again. Be firm with them and stand your ground.

Allright. I will defintely let my supervisor and my HR department know of this information as well. I'll give them a summerized version of the letter for their own records and let them know to please ignore the calls. Will I be required to pay for this loan even after I send the letters in the mail and through email? I want to pay it off if I have to. I don't want that on my record with my credit report or anything like that, as I am currently trying to even and clear off any debt that I have.

In regards to the wage garnishments and such, what should I do about that? Should I contact my HR department?

And I'm a little confused on what to do in regards to my Attorney General and the cease and desist letter.

Should I use the templet on this site or should I get one from my Attorney General? I just want to make sure I'm doing everything right, that they stop harassing me and they do not touch my pay checks or bank account.

I guess, in a way, is there a way that I should do these things? In other words, should I do things in a certain order?

After doing research regarding Internet payday loan laws in the State of Ohio, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of Ohio in general:

Loan Terms:
Maximum Loan Amount: $500
Loan Term: Minimum: 31 days
Maximum Finance Rate and Fees: 28% annual interest
Finance Charge for 14-day $100 loan: $1.08
APR for 14-day $100 loan: 28%

Debt Limits:
Maximum Number of Outstanding Loans at One Time: One, four per year
Rollovers Permitted: None
Cooling-off Period: 2 loan limit in 90 days
Repayment Plan: Yes, 60 days, no fees

Collection Limits:
Collection Fees: Bank charges (if disclosed); $20 collection charge; Court Costs after default; damages
Criminal Action: Prohibited


I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with the XXXXX to protect my interest in this matter, per instructions from The Ohio Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.

I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan.

Due to the fact that Internet payday loans must be licensed in the state of Ohio to be a legal and binding contract, your company should NOT issue loans to Ohio residents at all. I am requesting that you send me your license number, which enables you to offer loans to Ohio residents.

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the Ohio Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

I know I'm missing their address and contact information and I also need to file a complaint with the BBB and Ohio Attorney General and the FTC. I'm in the process of doing that. I just need some help in critiquing this.

ALSO (Sorry for the sudden rush of posts...)

I checked online to see what exactly my amount due was and when it was processed, so that I could make sure that I got all of the information right in this letter and got everything correct to the Attorney General, etc. and its telling me that the current balance is now 0 and when I go to see if I can re-loan, there isn't an option for me to do so.

So, what exactly has happened now? I'm sure they closed my account out from re-loaning, but now its telling me that there is no balance due? I'm somewhat lost on this.

Zip19 is the only one you are sending this letter to, correct? They are the only lender you have that is illegal, all the others are legal. As I stated above Think Cash is not a payday lender, they are a bank, which would make them a legal lender. Cashnetusa and ChecknGo are both legal also, I think they are registered as CSO's which means they are not required to be licensed, all they are required to do is register with the secretary of state, and their fees are not regulated unfortunately. So, you need to make payment arrangements with them.

Well, my bank didn't act fast enough and Zip19.com has taken out two payments of $463 from my checking account. Its just going to be returned again and I'm going to get two more overdraft fees. I've already talked to my bank and and discussed it with them, and they stated that it would be possible to refund those amounts and they said they were working on putting a stop payment against their transactions. That pretty much explains the $0 balance on my loan.

I hope this will get taken care of on Monday after the holiday. I've already sent them a cease and desist letter via email, filed a complaint with the Ohio Attorney General, the BBB, and the FTC. Just waiting at this point. I'm just hoping I did everything right.

And that is exactly why we advise people NOT to send out those letters until AFTER the account is closed. Once an illegal lenders learns that you are aware of their legality, they will wipe you out. They'll do it again too, if they get the chance. I really wish you would have followed the steps in my thread on how to deal with illegal lenders because it is very specific about not sending out letters unless your account is closed or secured. Sorry you have to go through this.

I honestly think that they had already planned to take it out of my account again before I sent out the letters. As I stated before, the account balance with them was $0 before I sent the letters out. So, in a way, I was going to have to deal with them taking money out of my account again without my permission.

My bank has taken care of everything, and even refunded me my NSF fees. Zip19.com just gave me a call from a different number, the same guy who has been trying to contact me has switched numbers this time. I'm just not going to answer.

In regards to the letters, do I send it to their general website email or is there a different email? I sent it to the general one, and something tells me that its not going to get me anywhere.

Think Cash is backed by the First Bank of Delaware. I recall reading something recently that FBD wasn't going to back them anymore but I can't remember where I read that , anyway, you were probably issued that loan before that came about.

As far as the steps they will take is the loan isn't repaid. You can do a search of this forum to see what other members have posted about their experience. The typical protocol would be they will either turn it over to a collection agency or collection attorney, and/or sue you.

Zip19 has several dba's which include; Integrity Advance, Netcashusa, iadvance, cashtransfercenter, E-Care Conact Centers, Northway Broker Limited, Northway Financial Corporation Ltd., so they could use any of the names above to debit your account.
I would use the email address they used to send you your contract because Zip19 has multiple email addresses.

My bank has gotten everything taken care of, but still no written response from Zip19.com or E-Care. They just keep calling and I refuse to answer.

Is there ever going to be some way to resolve this? I'd rather not just keep having them call me and I do want to pay something back, but I'm not going to do it through Western Union.

What are the results of doing these steps? Does it ever get resolved?

As long as you feel comfortable with the way your bank is handling this then that is a good thing.

As far as an end to this? It's hard to say, as long as you allow them to get to you it won't end, that much I can tell you. Don't chase them down to pay them, it isn't your responsibility, you have offered to pay them on your terms and if they refuse to accept it, then it's their loss. You can only do so much.

Just as a nice status update:

I am no longer getting calls from Zip19.com. I have sent 3 cease and desist letters to their email that they have on their website. My bank has stopped them from taking money out of my account. I do not get any calls from them at work (although I have only gotten one call from them before) and when I go to see if my account is still saying past due with them, I do not have access to the website.

I'm guessing something is indeed getting resolved? Its pretty much silent and I can't see anything on their website now. I'm hoping this is the case. I'm being very optimistic about this.
