My husband recieved a court ordered summons regarding a debt from a debt collections agency. Is is to late to contact them to make an offer? The summons indicates that a judgement will not be enter until 35 days have passed. I owe the debt, but do I have to pay attorney fees even before a judgement has been issued or before I even go to court. I would rather settle that go to court.

Any suggestions?

Hi Taylor

Welcome to the forums.

It's not late to place an offer to the collection agency regarding your husband's past account. They also will like to settle the matter outside the court.

Before you sign any deal with the collection agency, make sure that the company is actually holding your debt account. Get complete details about your accounts before you pay off debt. Also, once you have paid them in full, they will update your accounts with the bureaus. So, you should get something in writing from them.

It is better to make every correspondence in writing with the collection agency. Send all your mails certified with return receipt requested. You will have proof of all your actions taken.

Roxette

I'm disabled, and unable to repay a loan all at once. I have a co-signer, but, she as well is unable to help. She does have a job, but I want to re-pay the loan so that they will not garnishee her check, it is not fair, cause it's not her debt. I recieved a summons, but it had no date for court. I replied whithin the 20 days, given me.
