Options for collection agency demanding payment in full

Have a collections agency demanding payment of roughly $4000 in full on an account that was charged off. They suggested I might be able make two payments of $2000. Either way, I don't have that kind of cash laying around. Is a debt consolidation company an appropriate place to turn to in this situtation (as I have other debt that I could be taken care of as well) or am I just kind of screwed?


Some updated information... Turns out this isn't a collections agency. It's the Recovery Department for Wells Fargo Card Services. Whom I can only assume to be the orignal creditor. I offered to make smaller monthly payments... but they wouldn't accept that as they said, "You have already defaulted on your orignal payment aggrement by not paying the minimum amount due as stated in your montly statements. Pay in full by tomorrow or the account is being placed with an attorney or a collection agency."

With the creditor themselves being so unhelpful and bordering on rude (not in the firmness of their statement, but in the way the lady was taking an attitude with me), what options are available to me?

Welcome to the forums.

Before you make any agreement towards paying this debt account, know the SOL in your state. As your debt is charged off, it might be out of the statutes in your state as per the state laws. This is calculated from the date of last delinquency in your account. Please tell me the name of the state where this account last defaulted. I will confirm you if this debt is within the legal collection period.

If your debt is past the SOL period, place the item on dispute after the creditors have sent you in writing about this account. You will not be forced to pay if the statute is past in your state.

But, if the debt is within the legal collection period, you will have to consider paying it. Since the creditors are forcing you to pay a large amount, which you can't arrange, take some professional help. The consultant will negotiate with the company and will arrange you easy monthly payments.

Also, in the consolidation program, you will pay only one consolidated amount towards all your debt accounts. The late fees and other financial charges will mostly be wiped off from the total. So, you will have a reduced amount that will be much easier to pay.

James, the statutes of your debt account have been renewed . Written agreements are within the statutes for 4 years and in case of oral agreements, it is 2 years.

In such situation, I will suggest you to take some professional advice from the counselors. They will guide you in the right direction on how to handle the creditors. You can also enroll in the consolidation program and the consultant will do further negotiations with your creditors on your behalf. All the burdens will be off from your shoulder.

Recently obtained a copy of my credit report, noticed several collection accounts on file. A couple of the accounts list the original creditor and debt and the forwarded collection agency. How do I fix this?

Welcome to the forums.

It might be a clerical error from the side of the credit bureau if they are reporting multiple agencies for the same account.

Highlight the items and dispute it with the bureaus. They will verify the items and send you the updated credit report.
