Don't feel afraid of recording the phone calls. Make the CA feel that you will be using the conversation during the call for legal purpose and if they are violating the collection laws. You need to stand up as an informed consumer against the shady collectors. Your state requires consent from both the parties. If they continue to speak after informing about the call getting recorded, you got their consent.

I work for one of the top 20 fortune 500 companies...I won't say who ;) but, whenever a client calls in and asks me for permission to record the call I must reply with a "no" even though we are recording the call. That way, if it was ever presented in court, the recording would show us declining the permission to record. I have only had one bad issue, with a drunk elderly man, before about this. I don't know how companies are allowed to record but a customer/client can not?

Alot depends on the statre you live in, if they are internet or store front loans, etc. If these are store front loans, alot of them follow the regulations, and can take you to court. Try to work something out with them if they are store front. Any quesstions, please feel free to ask..KAren :D

I don't make outbound calls unless they are calls to customers/clients that have already called in, so I'm not really sure about that. I have never returned a call to a customer/client (I'd say I only make an outbound call maybe 5 times a month), but that is an excellent question. When I work on Sunday I will ask my manager how I would respond to that question if I did call out to someone! I don't like telling people they can't record, it just seems weird to me. However, I have only experienced it just a few times.

If so, I would think that the fact that your company is telling the caller that they are being recorded could be taken as consent from your company to also be recorded.
