When you tell someone to look at the laws pertaining to the state, do you mean the state the PDL company is in or the state I reside in, PA.


Are these all internet pdls? They would have to be if you live in PA since they prohibit them. First you need to open a new account and close the old one to gain control back of your finances. You also need to file complaints against each of the pdls with your state's AG office and the department which regulates these types of companies. You should also send them a settlement letter demanding they mark your account paid in full if you have already paid back the principal and interest in all of those roll over fees.

Who do you have the loans with? Check the total payments you have done on your pdls. Then, check with the laws to know the status and move from there. Do a little homework and you will have better idea on how to deal with the lenders. First, confirm the total payments done till now.

I live in PA too and have loans with payday ok, payday select and americash advance. After reading these forums I decided to take some action today. I have $500. loans with each of them. I contacted all 3 and explained how I'm paying astronimical fees and interests when in PA pdls are illegal, etc. I told all 3 that I am willing to pay my loan but not all of the high interest and fees. I have rolled over americash advance loan 3 times. I did all of this by email and said I would be following up via certified letter and sending a copy to the attorney general. Whe I got home and checked my emails, americash advance replied and said that since I was a long time customer, and they believe in helping and supporting their customers, they were deducting $400. from my balance and would only have me pay $200. more so they could get their principle back!!!! Hallelujah! Praise the Lord! So, I'm only paying $500. to them because they know what they are doing is wrong. I haven't heard from the paydays yet but I'm expecting a favorable reply from them too.
I just discovered this site late last night and I slept like a baby because I knew I had found relief. I have learned my lesson and will never use a pdl again. I serve a God who is a God of another chance! Ask and it shall be given....seek and ye shall find....knock and the door will be open! You have not because you ask not! God's word is alive and true! Don't be afraid. Take your life back and shake the duct off of your feet and live victoriously! YOU CAN DO IT!!!!

To mop352, did you contactthem by phone, email, fax? and do you have a copy of what you told them. I have loans with Payday Ok and Payday Select for $500.00 each and I have been paying on one for at least 11months and the other 8 months. I have paid back my principal over and over.

****UPDATE!!!****
I sent all 3 pdl companies emails. Americash advance is the only one that has responded so far and as of today, they have wiped my entire balance clean. They first offered to wipe $400 off and have me pay $200, but I emailed them back and listed how much I had paid from day one, and let them know that the loan was more than paid off. Aaron from ACA called me and talked to me and took care of everything. Payday Ok and Payday Select I have not heard from yet. They sent me the auto reply email and said they'd respond within 24 hours M-F, but I haven't hear anything yet. I even called Payday Ok and talked to someone who was not helpful and was very unprofessional. So, my next step is to send them a certified letter telling them I have withdrawn authorization of any ACH withdrawals on my account. I have already gone to my bank and gotten the form to complete which authorizes the bank to stop Payday Ok and Payday Select from doing any more ACH withdrawals. This is a free service because it is an ACH and not a stop-payment and there is a 3 day wait. So, I have to get back to the bank today in order for them not to be able to do another ACH on Friday. It's a time consuming process, but it is worth it!!!!

I have just gotten replies from both Payday Ok and Payday Select:



I received the same thing from Payday Select, with a balance of $514.29. Needless to say, I'm not paying another penny. I'm mailing my certified letter this AM and am attaching a copy of it to the email I am sending back to them. I'm also filing a complaint with the attorney general and I'm complaining to the PA Dept of Banking. I'll keep you posted.

I have loans with payday ok and payday select as well. I sent them a letter and a fax, I haven't heard anything. What did you say in your letter? I used the template letter provided on this site. I live in Pa. I borrowed $500.00 from both and so far I have paid $1614.43 to Payday Ok and $1322.67 to Payday select. I think I have paid more than enough. I also sent a letter to One Click Cash and they told me that I gave no scomplaint in my letter and that al I did was cut and paste a form letter used on the internet and that they would not recognize it or any further attempt I make. Has anyone else dealt with them?

I read this on one of the contarcts I have with ameriloan. Is this true? "Governing Law: By obtaining this loan and or renewal of this loan thereafter, both parties agree that this Note and your account shall be governed by all applicable federal laws and all laws of the jurisdiction in which the Lender is located, regardless of which state you may reside, and you consent to the exclusive exercise of regulatory and adjudicatory authority by the jurisdiction in which the Lender is located over all matters related to this Note and your account, forsaking any other jurisdiction which either party may claim by virtue of residency." By signing this did I legally forgo my rights of the Pa laws?

I have just received emails from payday ok and payday select offering me a $250. refund on each account. I called them and asked them how did that come up with this figure. Of course, I was not accepting that because I had paid much more than that. So, I was told that this is the amount they start with and was then offered $500. for each account. This was the most Jessica S. could offer me. She said that if I felt I was entitled to more then I should respond to the emails with the figure and she'd refer it to the appropriate dept. I told her that I wanted everything over the 24% state max refunded to me. I asked her what was the process of getting a refund and she explained how they will send me a release form once we agree on a figure to have completed, signed and notarized and returned to them. Upon receipt, they will cut the check the Following Friday and send it out. She also said I would not be able to access my account on line after tomorrow morning because my account would be marked paid in full. I don't need to access the account because I've already printed my loan history and the agreement. I will respond to the emails and request all monies paid over the 24% and request a letter stating both accounts are paid in full. I just want to add that all of this has come about after I attached a copy of the letter I sent to them certified mail with CC's to the Attorney General and the PA Dept of Banking. I will keep you posted on my progress. I just want to say thank you to everyone and I truly thank God for this site. I can live again! That's 3 down and 1 more to go...Magnum Cash Advance. I hav't overpaid them and will not over pay them. They are getting 24% plus the principle.

I too received emails that PayDay ok and select are marking my account paid in full. I also requested a refund and they said they would get back to me within 2 business days regarding that. If you don't mind me asking how much in excess of the 24% did you pay. I figured mine to be:

Select: $775.17
OK:$1066.93

I want those exact amounts back. Let me know what yours are and how you fair out.

I overpaid pd ok $274.88 and pd select $1051.95. I agreed to $500. for each account. I didn't fight for the $326.83 because 3 of the loans were from 2004 (which were already paid off). I'm just glad to have them pif and to get most of the excess money back. They have already sent me the emails and notice of the fedex letters they will be sending out. I should have them no later than Thurs. I'll keep you posted of my progress.

********UPDATE***********
I received my settlement release papers from payday ok and payday select by FEDEX yesterday. I am sending them back today so that I can have my checks cut and sent to me on friday. I now have to contact americash advance to get my refund. They were very nice when I emailed them and talked to them. They have marked my acct pif and blocked me out of their website. But, I want something in writing that it's pif and I want a reund. I will go thru all of my check registers to try to get an estimate of how much they owe me. Magnum cash advance is next. I borrowe $800. from them to be paid back in 4 payments of $313.66 each. They have taken 2 payments but I will not pay them more than the max state interest allowed. So, I'll keep you posted on my results. I just want to say thanks to everyone here because had I not found this site, I'd still be paying out my entire paycheck. Thanks so much again!!!

That's fantastic news - congratulations! And congratulations to the guests posting here that were able to obtain refunds, or will be soon!

This is a great sign that these companies are finally starting to get the message that we will not just keep paying and paying and paying until they bleed us dry!

Jenn, I would state that they are not licensed in my state. Go to http://www.paydayloaninfo.org and look up your state laws. Also tell them you have overpaid and want a refund. Tell them you are going to close bank account. Most important report these vultures to your Attorney Generals office Immediately. KYSIDE38

I just received my 2 $500. refund checks today from payday ok and payday select!!!!!!! This never would have happened without the help of all of you here. I am so thankful and appreciative. Now, I am going to have to battle it out with americash advance, but I will fight to the end. I will keep you posted.

I have a few out, just got rid of two and have to work on about 3 more, will be relieved when this crap is all over. I am letting them all go to default, it seems to be the only way that they will work with me. otherwise they just keep going with their outrageous payments, which only benefits them. They warned me that I would go on a payday black list, ewwwwwwww, scared of that. I asked them to please put me on it. It would be one sure way not to fall into this trap again.

Unfortunately installment loans seem to be legal. The storefronts are all turning to them. The difference is a storefront has a bank that backs them and that makes them legal. There are some dangerous installment loans going on right now. Best Wishes KYSIDE38
