are licensed to do business?


I do not think that Payday Avenue is licensed anywhere in the United States but please do not quote me on that. They use an address in the Republic of Malta, their phone calls come up on my caller ID as being from British Columbia, and I have heard they operate out of a call center called ecare in Winnipeg, Manitoba.

Pennsylvania's laws are tricky, from what I understand. They let pdl companies loan if they are licensed in the state they are located in, I believe.Below You will find the Payday loan laws for Pennsylvania here (just select your state),

They are allowed to be licensed in another state as long as they are not physically located in PA. They are also allowed to follow the laws of the state they are licensed in. Below is an email I recieved from the PA Banking dept:

Dear Ms.:

The 9.5 discount and the 24 % simple interest refer to calculations that can be used by companies that are operating in Pennsylvania and are licensed under Pennsylvania????????s Consumer Discount Company Act. With a number of exceptions, a lender that is located inside of Pennsylvania and who does not have any special lending authority (i.e., a special license or charter) who is making smaller loans not secured by real estate can only charge interest at a rate of 6% simple.

A lender that does not have a physical presence in Pennsylvania but who has lending authority from some other state can generally charge the interest rate and finance charges allowed by that other state.

The Department may or may not be reviewing this policy and I would not count on this e-mail as an interpretive opinion before starting any lending or business operations.

First of all, immediately send Payday Avenue a letter revoking the voluntary wage assignment that was in your contract. They will try to use this and get the money you owe from your employer. Follow up with your employer and tell them you revoke any voluntary wage assignment you have signed as well. As a warning Payday Avenue is famous for doing this and they also called my work and my references. They have not bothered me in the last few weeks. They really cooled off when they found out my employer was not giving them any personal information on me or turning my paycheck over to them.

If Pa. allows a company to operate under the laws of the state they are in, what if they are not in a state but a foreign country like Payday Ave. aka Cash Transfer Centers aka Northway. Do they then fall under Pa. law or are they lawless.

i was wondering if anyone knows anything about emerald payday loan? bmg marketing group? i have not heard anything from my att. general. also these companies call me at work and or e-mails. i have told them that they can call my ag and they tell me that they will not contact him. theya said they will keep calling and harassing me. so that tells me that they know something is not right because they won't call.

i took a 300 loan out with paydayave. i am unable to pay it this paycheck so i asked for a 2 week extension and they said it had to be paid today or they would contact my employer. what does this mean?
also they have told me i owe them 485.00 back
